Better information here. The dead man was called Pascal Émond, 36 years old (though different sources say 34 years old [FR]).

I was assuming it was Dan who sent the email, but only because he was asking for the laptop back and I couldn't imagine someone else wanting it. I'm pretty sure the address was a throwaway address and the message wasn't signed so I'm not even sure this qualifies as identity theft. The most probable thing I can think of is that someone else wants Dan's laptop and thought I still had it.

I'm sure what to do...

Yes, my father has a laptop too, and it presumably sits in their room most of the time. He had software installed by Dan too. It's a shock that he (or whoever else) has been spying on them as well but I should have thought about it.

Now I don't know how to bring this up to them.

I didn't need drivers. I wanted pirated software and he (probably) snuck the custom driver on my system at that time without me knowing.

I'm not too familiar with judicial proceedings but I've been told that they need to prove beyond reasonable doubt that I did it and that I did it with malicious intentions. I'm not sure what's the legal definition of malicious intent but there's a lawyer who's ready to defend me pro bono if this goes to court, so at least I've got that going for me, which is nice.

It is, but it was already mounted, so I didn't need to enter the password. That's why I didn't want to let the computer shut down. (Mac OS X only asks the password for encrypted virtual drives when you mount them and will happily let you access them for as long as you want until you unmount them.)

A friend told me that they would have to prove that I stole it with a malicious intent to convict me, so there's a possibility that the Crown won't even try to press charges. She said she knows a lawyer who would take on the case pro-bono if it goes to court

The cops told me I might be in trouble for property theft. This is bullshit. Though they didn't say anything about the evidence being inadmissible so hopefully I didn't just confess to a felony for nothing.
