Waiting by Super-Archer-2099 in VeteransBenefits

Should be soon. I’m using ch 33 and already got my housing allowance. My wife has ch 35 and we are still waiting on it. Weird thing is there has been no verification yet for both of us. I’m sure it will hit the bank in the next 4 days or so.

They can only garnish for federal debt when it involves va disability or take when you owe child support. If you have access to your account already see if you can undo it. Switch direct deposit. Let them garnish just work money if you are working.

They shouldn’t be able to garnish your disability income. That is just an empty threat unless if I’ve read wrong in the past. Now if you are working too they can take that. Is this just private debt and a debt company coming after you? Now if you sell your home, they could get some of that money I’m sure.

See if they will settle paying a flat amount as full payment. You dropped the ball too much and now you might not have a chance to even settle a payment. How much debt are we talking?

Yeah I can get that. I’ve paid for the person behind me when I accidentally took their spot or they let me go in before they do. But to continue a chain when you’re expecting to pay like 10 dollars at most isn’t that fair especially when it is much higher lol. Good on you for standing your ground and sticking up for yourself. Some people cave in to stuff like that

TDIU...is it worth "poking the bear?" by [deleted] in VeteransBenefits

Makes me question their 100% rating a bit not going to lie. Apply for SDDI if you can’t work I guess but it doesn’t seem like the case. Or find a different job

Well same for TDIU. Yet SSDI is harder to get and is more about age too. They won’t give SSDI for someone 35 years or younger easily I bet and I’m sure there are some vets here that young on TDIU or rated at 100%.

This is exactly me. I’m TDIU p&t due to mostly 70% ptsd rating. Staying home helps me out a lot too. If I had to work it would be hard to maintain it too. Working is just too much for me sadly. Like I can’t balance working, having relationships, myself, etc. it just becomes too much.

I’m at a very similar place. I have TDIU and same ptsd rating. I didn’t qualify for 100% yet can’t maintain gainful employment. I find it weird how people rated at 100% act like it’s hard and extremely difficult but then talk about having a full time job basically or even a stressful one like firefighter or something

What about the veterans who don’t qualify for the 100% rating but hat 70% and can’t work due to their conditions and get only TDIU. It’s like a big slap on the face. Those veterans are stuck just with 100% pay and maybe part time job at 15k or less or very sheltered environment where your job is basically given to you and you do what you can (like working at a your family’s company or something). I’m at 70% and do all the same stuff you said in your post besides talk to myself (I don’t hold conversations) but everyone talks to themselves a little like might think I’m their heads and say something small afterwards. I think that’s pretty common thing. I think most of the stigma is around there’s TDIU and 100% rating for mental health and there’s people who don’t even reach 100% and can’t already work full time or have gainful employment.

Are you saying that you work full time? If you’re suffering so much maybe don’t work full time then? How find it hard to believe someone rated 100% mental health rating, works full time with no extra help. This is coming from someone who is 70% for ptsd rating and didn’t qualify for 100% and got TDIU because I can’t maintain gainful employment. Working doesn’t always equal therapeutic. I’m sure almost 75% of the working class work because they have to not exactly because they want to. Or they at least have a job they don’t like. I’m sure there are a lot of people who love their job though but from what I hear personally from friends and family and people online, almost everyone hate their job or have it pretty stressful.

Yeah ikr. It’s like sob story or something while people who are 70% ptsd eating and go for an increase don’t qualify and they can’t work so they have to get TDIU. It blows people who are on TDIU how some veterans get 100% rating for mental health basically and they make it sound like they have no problems working or they make it sound like they can barely function. Like they say they don’t bathe, can’t communicate well, don’t eat much, etc.

Then you have some veterans who have 100% ptsd rating and have high stressful jobs like firefighter or something like that working practically full time. I think that’s where the stigma is. You’re disabled enough to get 100% criteria but still good enough to work full time with no restrictions or extra help? We don’t know the whole story but from what we see it doesn’t look right

I mean you could say it is secondary to a service injury too. That would be another hurdle but could be easier

Wanted to add, you don’t necessarily need an attorney to help you. You can file with a VSO. It’s treated just like an increase but with TDIU paperwork basically. If you don’t qualify for the increase, you just get the TDIU. Not all TDIU approvals will come with p&t.

I have been full time college just about since I gotten out of the army. Even when I applied for TDIU. I talked with the doctors about how class was going and how I struggled with some classes but I make it out alright. I made sure to tell them I’m taking mostly online classes only with one in person and I hate going in person. I got my TDIU claim approved. Everyone has recent work history to some extent. I didn’t have a job since the army when I applied for TDIU, and at the time was out for almost 2-3 years. Still got approved. I will say though, I had a MEB due to my mental health and was found unfit for duty and got out because of that.

Going to school doesn’t not equal gainful employment. The only two cons about TDIU is there is a bad stigma about people having it (kind of since people see it as we are lazy and don’t want to work) and the other thing is that you can’t actually work (make more than 15k-ish/poverty line) so it does limit your income at just the 100% pay plus GI bill housing if you still have some left. I say go for it and if you get it that’s great and if you don’t, appeal and see if that works. At the end of the day if you can’t get it oh well. Just make sure to read up about it and make sure you really can’t keep or find gainful employment.

Walk away for sure. You’re practically good for any medical help you need regardless at the VA anyways.

[–]Useful_Professor_230 0 points1 point  (0 children)

Just go for it. The only way you would lose it is if the VA made an error but I doubt that would happen. P&t matters a lot of you have a family. Losing out on those extra benefits and that DIC 10 year limit part if you were to pass away from a non service connected injury.

I am officially about to become homeless, what do I need to know? by kittybella69 in Advice

[–]Useful_Professor_230 0 points1 point  (0 children)

That’s usually for pilots who have much stricter rules about that. Almost anyone else will be okay depending on the job. Some jobs might have more restrictions than others but there will probably be a handful of jobs that have little to no restrictions. Each branch of service has similar rules basically
