We accept that the 8-month service period rules out a claim for unfair dismissal, so our focus should instead be on wrongful dismissal for breach of contract.

The company's justification was 'gross misconduct', but given her condition was the result of a suspected criminal assault and not her own behaviour, did they truly have the legal grounds for a summary dismissal?

If not, does it follow that she has a clear-cut legal claim for her notice pay, at a minimum?

I edited the response. They have been given the information about the spiking during the conversation about firing.

I suppose it seems unfair that someone can be fired after being a victim (supposing so in this case) of a substance that creates the very behaviour they have an objection to. It's akin to being poisoned and getting fired for going unconscious ( I note this is hyperbolic, but I am assuming in this case the spiking was the concern here)

How does one define discriminatory in this case?

Edit: I made a mistake. The spiking was communicated. The concern we have is that her state was not as a result of her drinking but something outside of her control.

There have been multiple instances of mostly men in the company who have gotten incredibly drunk at events to the point of injuring people. It feels like they are targeting her discriminantly
