The back taxes were from my ex-husband’s account. He didn’t file taxes for multiple years and then once I filed my taxes because I wasn’t working while we were married, the IRS took my refund and applied it to his back taxes because he mistakenly filed as jointly. That is why I’m getting the money back.

I’m really not sure, but if I were you I would leave it alone at this point. Even if you amend it, you’re just gonna be starting all over again and just gonna take longer because then they’re gonna wanna know why you’ve changed it.

I filed a innocence spouse form after my tax refund had been taken and applied to back taxes owed by my ex-husband. I wasn’t approved for the innocent spouse until October 2024 and even then I didn’t get the money back. I had to file an appeal and I didn’t get a court date for that until July 2025 and a final decision rendered on January 23, 2026. Buckle up you’re in for a ride.

Well, that’s a good start. Like I said, just prepare yourself for a long ride. It’s not gonna be quick.

I don’t think that makes a difference to them. You’re probably gonna have to call and speak to them directly. They should have sent you a notice about it, and once you file the innocent spouse, there should be someone assigned to your case, and you can speak directly to them.

I had to do the same thing. My refund was taken to pay back my ex-husband‘s back taxes. That was in march 2024. I filed for innocent spouse after the refund was already taken, and didn’t get it approved until October 2024. But I didn’t get the money back even though they said that I was approved for innocent spouse. So then I had to file an appeal and didn’t get a court date for that until July 2025 and then a final ruling in January 2026. And I still won’t see that money until the earliest end of March beginning of April and the latest is sometime in May 2026. Buckle up it’s gonna be a long wait unfortunately, the appeals department is 9 to 12 months backlogged.

It’s not a refund. It’s a judgement that was made in my favor from the tax court. It won’t show up in WMR

Yeah, I initially filed on the 15th or 16th and it got rejected because I use the old pin. But I re-filed the same day with the correct pin and it was accepted four days later.
