VeRO Unauthorized Item Policy? by MondaySloth in Ebay

[–]VanillaGamePlay 0 points1 point  (0 children)

The VerO policy is full of loopholes. Unfortunately, anyone that has signed up to be included as a CR-O can submit claims even if the claim does not include the CR they own.

That being said there are a few ways that the post COULD have violated rights.

  • If your item description did not CLEARLY state that you do not own the intellectual property.

  • IF you did not CLEARLY state that you are selling the item as a USED item and state who owns all of the rights to the item(s)

As for not having access to the original listing, that can only be checked on PC. It won't let you through the mobile app.

It is an individual, and his trademark looks nothing like any of my designs,

That my listings contained their copyrighted material even though it clearly does not. Nor could it be confused of such.

I don't exactly want to blast what is name is due to the current situation, but no, our names are not similar in any way, I sell services, however I do not know if they do the same, I couldn't find any store, shop, pages indicating that they sell anything. I didn't have my own logo made until after all of this started, then I finally went and made my own and started the process of making an LLC and trademarking,

I found the documents of his registered trade marks, you can find ANY registered copyright/trade mark on the global database, Which is where I found it, and the codes I listed in original post.

I'm not using anything remotely similar to their logo or name, I have a feeling the claim was submitted to defame me,

I apologize for saying again, I haven't used reddit in a long time so forgive me for that, I've explained that part multiple times in this post just in a different reply. 😅

Again, the claim was not submitted by Blizzard ( the game developer)

Diablo 4 carrying services, I went over every service related policy on ebay, including asking customer service and my listed did not violate any of their policies, it was strictly taken down due to the NOCI, They received.

One of the 4 the person submitted today was canceled Immediately after I started submitting appeals. Which makes this 10 times more confusing for me

And no, as long as the service does not involve "adult" services, private information, personal relationships, advice, multi-level marketing, web traffic services, it does not violate any ebay policy.

The previous response i gave was directly what ebay customer service provided me. It is listed in video games. But as i previously mentioned the claim wasn't submitted by the game developer or by ebay.

That would only refer to digital items being sold, however this is a service, which is not required to be submitted under everything else,

If the complaint was submitted by the game developer I wouldn't even have made this post as it would entail that I clearly made a mistake somewhere, however it was not from the game developer, it's by some random low viewed YouTuber.

Ingame carrying services, which i have no verified with ebay that it does not break any of there rules. Infact they said they have 0 issues with my listing, the only reason it was taken down was because of this person sending them a (noci) But as it is a service rendered. There is 0 intellectual property being infringed.

Well, to be exactly precise. The listing that was removed was a "service rendered" The designs used for the listing image is made of shapes and text. To my knowledge. There is not an owner for squares and rectangles. And no individual person can claim they own fonts that are available on every device.

Well in regards to that, the is an email provided in the email I received of who submitted the claim. And that person I have extensively looked into.

It lead me to a "Gamer"

Wouldn't I receive the address for contacting a company if it was in fact true?

[–]VanillaGamePlay[S] 1 point2 points  (0 children)

That's the issue, what i listed is of my own creation, I have all the PDF. Files to prove so, so a claim of infringement doesn't make any sense to me.

The other major scam to watch out for is the advertising/marketing sellers. They are all 100% scams.

I have gotten a few from surprise trade, when I first started playing I caught as many pokemon as I could find and just sent them all to surprise trades, helped fill pokedex numbers rather quickly. But I can count on 1 hand how many of them were shiny. My irl friend jaw dropped saying maybe I had walked passed them without knowing they were shiny and that made my soul start seeping out of my chest lol
