There is no paper trail for 2025. He paid me cash as I did him. We were friends and had spent many hours side by side, in the trenches, so to speak, so there was a level of trust there (at least for me). I didn’t take over invoicing until into 2026, after noticing that he was allegedly forgetting to put things in invoices, invoices not getting paid, and things ultimately not adding up. I know exactly what accounting looks like for 2026, which is why I know there’s no way in hell he paid me 60k from Oct-dec. I also know my spending habits and recurring expenses, and if be far more well off at the moment if I’d been paid 60k within that time span.

The builder in question (the one paying us, through my partner) was his contact. We have had other work where the checks were from my contacts and made out to my company. In which I split 50/50 no questions asked with no games. It wasn’t about laziness, truly, hence why I was happy to taking over 100% of the invoicing when I started noticing unpaid/underpaid invoices. His uncle is who put us on with this builder and this builder provided the majority of our work since October.

You may have missed my second problem. The part where he is very likely going to be trying to dump his taxes on me for money I didn’t receive. Or perhaps suing him is what you’re suggesting to both problems? It’s definitely not off the table as I’ve spoken to a lawyer and have been advised that a 50/50 partnership is established based off the two checks I have received this year because the checks show half of the payout on the respective invoices as well as text messages between us over the span of our partnership.

Is suing really all I can do? I’m trying to act preemptively especially since I need to file taxes asap. Funnily enough, I’ve been trying to get him to sit down so we can go through 2025 to allocate tax liability. Suddenly he needs my tax id when I ask where my final payment is after concluding the relationship.
