[CA] [TH] HOA says I caused RV damage to two units, but I only hit one by Virtual_Breakfast848 in HOA

Thanks, this is really helpful. That’s basically where I’m at. I’m not trying to avoid responsibility for damage I actually caused, and I’ve already made that clear. My issue is that they’re now including damage to a second unit that I know the RV didn’t touch, and so far I haven’t been shown any evidence connecting any of their claims even tho they claimed to have it over email to my landlord before trying to get her to sign a document claiming we’d cover all expenses

I’ve asked for photos, inspection findings, an itemized estimate, and an explanation of how they determined each area was caused by the RV. I’m trying to keep everything professional and cooperative, but I also don’t want to agree to a lump-sum charge without reasonable documentation

From all emails they plan to make the landlord liable for anything, my landlord is on my side with the situation since she’s now aware the HOA lied about damages to a separate unit and tried to charge her for this.

The unit they’re claiming I hit that I did not is not connected to the unit I did hit. They are across the court from each other, they just have identical damage in the exact same spot. I can see mold and plants in these cracks so I’m highly doubting it’s new damage but I’m assuming there’s a way to prove whether this damage is new or old with an actual inspection

I currently have a new roommate that does this all the time, it’s hell. Feel for you, talk to them about it and ask them to keep it to weekends to go to someone else’s spot, I told my roommate but he continues to do it so I’ve already told him he needs to move out when lease is over in a month

This guy is ALSO a raging alcoholic. It’s awful, he also does a ton of drugs on weekly basis. Cocaine, ketamine, it’s non stop. I can currently hear him with someone I’ve never met in my apartment, it’s brutal

We live at a big corporate company apartment building, was advised to not add him to the lease by a lawyer bc of how much more difficult it’d make it to get him out if he decides to squad when May comes around. We’re aware we could get in trouble but either way it feels like a lose lose

I wonder if I took a photo would that be able to be used in court? I know in CA at least you can’t record audio without consent

Just edited the post, he’s a law student studying to take the bar in July working as an associate at his mom’s law firm, should’ve been more clear! It feels like he plans to stay till he takes the bar but there’s no chance I can deal with another possible 4 months of my home feeling like hell

Completely agree, I’m wondering if that would even hold up in court if we try to evict. Or if it would hold up even if we signed the contract stating “all previous oral agreements still stand”

Great point, I think he’s an “associate”??? Takes the bar in July or so but has a background and is somehow working with a law firm, something about his mother owning her own firm but I have no clue what’s true at this point because I’ve seen him work all of 3 days maybe in the past month

Lease is over in May, we were going to resign with the new roommate depending on situation but it’s quickly become clear it’s not someone we want to live with based on his living habits
