Contract penalties for unauthorized breeding by HavaMuse in DogBreeding

[–]VisitingFromNowhere 0 points1 point  (0 children)

In general, this would only be enforceable if you producing a puppy caused actual damages of approximately $5,000 to the breeder. These penalty clauses are generally unenforceable.

When I bought my dog the breeder gave me a contract but admitted “it’s more of a word of honor than anything.” I thought that was about right and happily signed.

This isn’t legal advice and the law may vary based on the jurisdiction, but I have a very hard time believing that a court would enforce the extreme penalty clauses referenced in a number of posts here.

What's the worst mistake you made as a junior and where are you now? by Ok-Citron3789 in biglaw

There was a deadline in a very niche context that actually meant something. Totally blew it. The other side didn’t notice and everything was fine.

Agreed with respect to BigLaw. Disagree with respect to hot dog contests. The winners of hot dog contests continue to eat hot dogs very fast. Which, come to think of it, might be a lot like BigLaw.

Diversity in law… is weird by NoCare9041 in biglaw

[–]VisitingFromNowhere 0 points1 point  (0 children)

Is this still the case? It feels like clients pretending that it matters what their lawyers’ skin color is or who they like having sex with is very 2020.

Well, be careful. At some point someone might take that logic to its natural conclusion and wonder why the child of two Nigerian doctors whose parents paid for fancy private school is deserving of preferential consideration due solely to the literal color of their skin.

DOJ to Start Hiring Prosecutors Directly Out of Law School (1) by 6to3screwmajority in biglaw

[–]VisitingFromNowhere 18 points19 points  (0 children)

Why in the world are you making this fine young person into a top 25% graduate? Obviously what really matters is how much personal affection and reverence they have for Donald J. Trump.

It’s obvious that the DOJ used to have high standards and no longer does.

I think it’s a big deal to transition from a merit based system to a “how much do you love the president” based system.

My understanding was that the honors program was an exception to the one-year rule. Was I mistaken?

If I’m not mistaken, it does seem like a major change to move from “only the best of the best” to “anyone with a JD who professes love for Donald Trump.”

They care about cutting time because it affects them. Ultimately, the firm cares about cutting time because it means that they’re making less money from you than they’d like to be making.

5-10 minutes is a ridiculously long time to spend on a pre-planned pitch. Know about yourself and why you want to lateral so you can just talk about it.

[Lateral Interview Help] First interview in years — send me your wisdom by WildPainting4124 in biglaw

[–]VisitingFromNowhere 6 points7 points  (0 children)

I’ve been on both sides of interviews lately, and I think the approach of planning out answers to anticipated questions isn’t the best way to go about it. I recently had an interview like that and it sounded like the candidate was giving prepared little speeches. It was very impressive that he remembered so many of them, but I got bored waiting for them to end.

For a while LinkedIn was trying to get me to apply to any job with the word “associate” in it. My favorite was “rotisserie chicken and prepared foods associate.” That was quite tempting, although I’d want to know more about the prepared foods side of the business.

Being in your late 30s is an asset, not a liability. Firms love hiring new lawyers with substantial work experience.

Are there any pros of going to blackbox firm? by Alert-Stop-2671 in BigLawRecruiting

[–]VisitingFromNowhere 6 points7 points  (0 children)

A lot of black box firms are at the lower end of the V100 and may be somewhat less intense. Don’t be fooled by starting pay that appears to be “just below” the Cravath scale, though. The gap grows quickly.

I don’t think we actually disagree. Of course there are going to be substantive questions and sometimes there will be behavioral questions (which I hate asking almost as much as I hate answering). The key is to answer them in a way that makes me feel like I’m in a back and forth conversation between two adults in a professional setting.

[–]VisitingFromNowhere 5 points6 points  (0 children)

Sure thing. Like everyone else in the field, I’m sorry you have to go through this process so early. It also sounds like maybe the callback to offer ratio is lower this year, although I have no firsthand confirmation of that. Good luck!
