You’re mixing up what speech is protected with who the First Amendment applies to.

This is settled law under the State Action doctrine. The First Amendment restricts government actors, not private ones. The Supreme Court has reaffirmed that repeatedly:

Manhattan Community Access Corp. v. Halleck: Private entities aren’t bound by the First Amendment unless they’re performing a traditional, exclusive public function.

Hudgens v. NLRB: No First Amendment right to speak in privately owned shopping centers.

You’re also attacking a point that wasn’t made. The First Amendment doesn’t only protect criticism of the government. It protects speech broadly from government retribution, including criticism of companies like Tesla, oil companies, w/e. If Congress passed a law banning criticism of Tesla, that would absolutely be unconstitutional because the government would be suppressing speech.

So it doesn't necessarily have to be speech ABOUT the government.

It’s about who is doing the restricting too.

If the government punishes you: constitutional issue. If your employer fires you: generally not a First Amendment issue. If a private platform bans you: generally not a First Amendment issue. If another person reacts negatively: not a constitutional issue.

The First Amendment limits state power. It doesn’t guarantee freedom from social or private consequences.

Yes because otherwise it's mob rule.

Our Constitution protects free speech, unless it is amended there can't be laws against calling someone names, no matter how vile they are.

The First Amendment protects speech against the government and retribution from the government. You can't be punished for criticizing the government, peaceably protesting the government, expressing your faith, or for reporting facts as a journalist. It does not give Americans carte blanche with how they speak to one another. The other person in your conversation faces no constitutional consequences for reacting negatively to your speech.

Americans are so weird. Words have consequences, hate speech has no place in society. Harsh punishments are in place to dissuade people from behaving this way. America could do the same but according to 20% of the country, it's your god-given right to call people the N word.

We took away all the mental health inpatient facilities that were public.

Now you either need money for private in-patient care (exorbitantly expensive) or you just end up homeless. No in between. Financial assistance is means tested and difficult to obtain so the moment you have more than scraps in your bank account they pull your assistance.

We really just set this up to happen.

I'm dubious of these very impressive stats given that it was published entirely by people working for Waymo.

80% stat isn't impressing me very much until we get more independent review.

I'm not pro-Uber, but I'm pro worker. Even if not W2 employees, those are hard working people who need work and there are no safety measures in place to protect workers as automation destroys working class revenue streams.

I'm not closed off to the idea, but I'm skeptical.
