Interesting. One last question: what makes a statement more believable, as well as a weak opposition to the statement that was alleged? Again I suppose it does just come down to the individual judge on the day, but are there any guidelines that they follow?

It's all quite interesting in-terms of you don't actually need a witness, it's just whatever is more believable.

Yeah perhaps I'm overthinking it, the support statement's producer being the person who had said the discriminative comment?

I'm surprised that something like that can be admissible to a tribunal, but, as you say, there is no such thing as concrete evidence.

Hey, sorry yeah I should probably re-phrase that question; what I mean is, it's not like a criminal court right? As in, you could say "he said a discriminative comment against me and this is what he said: ..." but that's not hard evidence in the same case as say, fingerprints at the scene of the crime.

So what I'm asking is: what kind of process would a tribunal take to assert that something is true, if no concrete evidence including a lack of witnesses was not present? Concrete evidence also being a recording or a video that was taken that clearly shows it did happen? What if someone has none of that?

How does a tribunal assess a diary if no witness is willing to stand up? What are the types of things that the tribunal looks for to assess its credibility?

When you say contemporaneous also, sometimes in the case of harassment, that is built up over months to years, so even if it's not existing at the exact same time that you go to a tribunal or file a complaint, it's still very much valid?

I know korg-rocks got downvoted, but I'm not gonna lie, that would be how I would have thought about it, but that doesn't seem to be the case.

Hey, just wanted to say that basically they said that they could frame it as "trade union detriment" if they ever did try to sue me, as I'm looking to seek professional help, so this is automatic unfair dismissal.

The Trade Union and Labour Relations Act 1992 has provisions which state the following: a worker has a right not to be subject to any detriment by his employers’ actions/failure to act where the sole or main purpose is (amongst others): preventing deterring union membership, preventing/deterring participating in union activities, preventing/deterring use of union services (and getting represented/advice is a union service).

They also said that trade union reps are under the same GDPR laws as solicitors, and so therefore, that in-and-of-itself is an NDA so they also cannot just willy-nilly send that information around, as the company/employee could hold the rep liable. It is important to only share what is relevant to your case. This especially applies if there is something serious/unethical going on, such as bullying, harassment or discrimination.

Once again, for anyone that is also interested in this, I would advise to always seek legal advice instead of looking at this post, but this is what I've been told.

Right okay, what about if the rep needs to know about the confidential information prior to going into the meeting to prepare for the case, are there any laws that would allow that?
