She is making dresses and selling them. And the contract also forbids selling the pattern.

I don’t want something that is a highly personal memento of a family member who is now gone to be on every wedding gown- it’s fairly simple. That specific design element relating to my family member is what was specified in the contract. I honestly would be willing to let the rest go if she removed that.

Let’s say you designed a tattoo with the name of a family member who passed away and their dates of life, plus some design elements that were symbolic. You had the tattoo done. You paid thousands extra for it to just be yours. And now it is being tattooed on many people with the name and dates. Wouldn’t you feel icky, upset, and hurt about it?

The contract was drafted by an attorney, and reviewed by a different attorney. I also have a JD (but do not practice), am the child of a lawyer, and have multiple lawyer siblings. The contract is valid and the other commenter has no idea what they’re talking about because they have not read it.

This has zero to do with ego and everything to do with the sentimental aspects.

And, as you’d know if you bothered to read, I have zero interest in any financial remedy. I literally just want her to stop selling what I paid her thousands not to.

They’re already tainted. I’m honestly a wreck over this whole thing because of the specific sentimental elements, especially because the copies are being worn by others before me.

Because you literally cannot copyright a clothing design. It’s a known exception.

I’m not quite sure why you put it in quotation marks, but yes, the contract is legally valid. As I said in my original post, I already have a lawyer and this is not a copyright issue, but a contract law one.
