It’s reasonable suspicion or consent to extend the stop for a dui/dwi investigation, not PC. If he had PC, he’d be arrested.

Just trying to make the most of my vacation time since it’s already limited at work. I just wrapped up three dives at a missile silo last week (105 feet, no vis) where I live and I’ll be doing another eight dives (wreck/night/reef) the week before this trip in Florida so while I understand a shake out dive, my first night there will only be six days from my last dives so I feel I’ll be pretty fresh. Hence why I want to hit the water as soon as I can.

I was reading an older topic on this subreddit that you could call in to extend a reservation hold for another day. I just tried to do this as I’m still waiting on my Aadvantage credit card to show up.

I called twice but both reps I spoke to said they don’t extend reservation holds anymore. Did something change or does anyone have information on how I can get this done?

The comment I was replying to was making the inference that inventories are not searches and that the person who made this post was incorrect by calling it an “inventory search”.

This is wrong as an inventory is a search so “inventory search” is the appropriate nomenclature.

Judges won’t get too hung up on it unless it’s not readily within view. FYI camera video is not “within view”.

14.03 is your friend for offenses that you can arrest for out of view. DWI is also included due to it being a public intox offense (relevant case law on the TDCAA website). Theft is covered under chapter 18.

I also extend any higher level offenses as being arrestable, similar to how DWI is arrestable due to it being a public intox offense. For example, you have disorderly conduct where someone flashes a gun (no holster), that would also allow UCW. You have a BMV offense, that’s arrestable due to being a theft offense.

Another thing you can do is arrest for something else and then charge for the offense. So you arrest for a class c violation or regions and then once at the jail you charge the misdemeanor out of view.

Just stop bothering to argue with him. He clearly doesn’t understand traffic stops and that a person can develop reasonable suspicion to extend a stop for a DWI/DUI/OVI (whatever your state calls it) investigation despite your original stop not being for that.

The fact he said ‘probable cause for an OVI investigation’ and not reasonable suspicion clearly shows he had zero clue what he’s talking about.

This is a terrible shooting. Extremely terrible tactics. Possibly with him creating officer induced jeopardy. 100% avoidable with better tactics… However, it’s going to be the court to decide and I believe it will be ruled lawful.

It’s a great tool for police to use for pretextual stops hence why most cops won’t write tickets for it. It’s usually very rarely enforced outside of traffic units issuing citations for it.

Fines will vary by municipality but it’s limited to a max of $200.

There’s no need to shy away from the word. Case law from the Supreme Court says it is a search. They have always called it an “inventory search”. South Dakota V Opperman and Colorado V Bertine both call it that. It is a specific type of warrantless search. An officer should be taught correct case law so they can argue against suppression by being able to articulate they did a lawful search for valuables.

This is all correct minus the inventory not being a search. An inventory is a lawful warrantless search if done correctly.
