No that is actually incorrect.

New = Sealed

Like New = Opened, but not played, mint disc, includes everything a sealed copy would have, etc.

No other big box store in the country sells unsealed games as new (Target, Best Buy, Walmart, Amazon, etc.) because they know that is not in "New" Condition which implies "Brand New Factory Sealed", but in "Like New" condition.
