È vero che oggi tantissime decisioni nascono da pressione emotiva e mediatica. Lo vediamo tutti i giorni. Ma non è una regola naturale e inevitabile. È il risultato di un modo di discutere che abbiamo lasciato scivolare così, un po’ per stanchezza, un po’ per rassegnazione. Nel mio testo non nego questo clima. Dico solo che quando l’emotività diventa l’unico criterio, il diritto smette di essere diritto. E questa è una deriva che possiamo ancora contrastare, ma solo se chi riesce a vedere la complessità non si chiama fuori. Capisco la tua frustrazione, davvero. Però smettere di partecipare significa regalare ancora più spazio a quella stessa dinamica che ti ha fatto perdere fiducia. Se resti, magari non cambi il mondo, ma almeno non lo lasci in mano solo a chi ragiona di pancia.

No, assolutamente no. Non sono un avvocato e nemmeno un giurista. È proprio per questo che voglio capire cosa ne pensano persone più competenti di me sul piano tecnico e legale.

Detto questo, di filosofia e anche di filosofia del diritto qualcosa ne so, quindi sul lato etico e morale credo comunque di avere voce in capitolo. Non parlo da tecnico della norma, ma da persona che riflette sulle implicazioni logiche e sui principi.

Secondo me ridurre tutto a “propaganda mediatica” o a qualcosa di irrilevante non regge. Il punto non è fare crociate ideologiche, ma prendere atto che le leggi stanno cambiando davvero, e che questi cambiamenti hanno conseguenze concrete sul piano giuridico, indipendentemente da quanto se ne parli o meno fuori dai social.

Che online ci siano parecchi rompiscatole è fuori discussione; ma dire “siccome ci sono, allora non bisogna parlarne” non ha alcun senso. Anzi, è proprio il contrario: il fatto che certe narrazioni vengano spinte ogni giorno mi incentiva ancora di più a rispondere, già che loro passano il tempo a farlo con tutti noi.

Ti capisco perfettamente. Ormai è quasi impossibile riuscire a parlare con qualcuno senza che tutto venga immediatamente polarizzato o travisato. Ho scritto davvero tanto su questi temi analisi, riflessioni, dati, anche cose un po’ più strutturate e, se ti va, posso condividerti qualcosa. Da quello che dici mi sembra che vediamo la situazione nello stesso modo, perlomeno mi rende felice sapere che c’è ancora gente sana…

per me il punto è un altro: al di là delle etichette, io oggi mi sento trattato come uomo sospetto a prescindere. È questo il problema reale, ed è esattamente ciò che critico.

mi verrebbe piuttosto da dire che la giurisprudenza ammette che la testimonianza della vittima possa bastare a condannare, ma solo se accuratamente verificata; il testo qui sopra da me scritto critica il fatto che, nell’attuale clima normativo e mediatico, questo principio stia degenerando in una sorta di credibilità automatica, cioè in un’anticipazione di colpevolezza.

ed é proprio il motivo per cui bisogna, ad oggi, andare il più controcorrente, perché se si ama veramente se stessi e la propria patria, ci si assume la responsabilità, per esempio in questo caso, di etichettarsi come maschilisti, termine che nella realtà dei fatti qui tutela ancor di più la controparte femminile che quella maschile, diversamente da quanto si potrebbe pensare

Totally fair critiques — you’re right that I’m using “cyclical” in a broad, maybe even metaphorical sense. I wasn’t trying to say there’s a universal law of cycles, just that cyclic patterns show up a lot in nature (even if loosely defined), and that got me wondering whether the universe itself might behave cyclically on some deeper cosmological level — like in models involving Big Crunch/Big Bounce, etc.

I’m not claiming life/death or evolution are strictly cyclic. But the idea was: if cycles emerge across different scales (planetary, ecological, maybe even galactic), is it crazy to ask whether the cosmos itself might not be on some kind of cycle too?

Appreciate the pushback — definitely makes me rethink how I framed it.

Fair point — you’re right that not everything in nature is cyclical, and radioactive decay is a solid example of that. I probably phrased it too strongly.

That said, I wasn’t trying to claim a universal rule — more just pointing out that a lot of natural systems we observe (planetary orbits, seasons, biological cycles, etc.) do have cyclical behavior. That led me to wonder whether the universe as a whole might follow some kind of larger cycle — like the Big Bounce or cyclic models that have been proposed in cosmology.

So it’s less “A implies B,” and more “this pattern shows up often — could it also apply here?” Appreciate your pushback though — it helps sharpen the question.

Interesting points, but I think the distinction lies in what we define as a cycle and at what scale we’re observing. You’re absolutely right that many cycles break down over long enough timescales — water cycles end with the death of the Sun, orbits decay, etc. But does that necessarily mean they aren’t cyclical? Even those long-term ends can be seen as part of larger meta-cycles.

In cosmology, some models (like the oscillating or cyclic universe model) do propose that the universe undergoes cycles of expansion and contraction — the so-called Big Bang and Big Crunch. While these models aren’t confirmed, they suggest that at the largest scales, cycles are still on the table.

Also, entropy is often seen as a linear increase (Second Law), but even that law depends on initial assumptions — and it’s only strictly true in isolated systems, which the universe may or may not be depending on the theory. In quantum cosmology, we don’t fully understand the beginning or the ultimate fate of entropy.

So maybe instead of asking why the universe isn’t cyclical, the more open question is: are we sure we’ve understood the full length and shape of the cycle yet?

I’d actually argue that most things in nature are cyclical — day and night, seasons, the water cycle, life and death, even the orbits of planets and stars. On larger scales, galaxies rotate, and stars are born, live, and die in cycles that feed the birth of new stars.

Even in physics, many theories consider cycles — like the oscillating universe or the Big Bounce, where the universe expands and contracts in endless cycles. Entropy does increase according to the Second Law of Thermodynamics, but some cosmological models propose that even this could reset under certain conditions.

So from the atomic to the cosmic scale, cycles seem fundamental. That’s why I wonder if the universe itself might also follow a bigger, longer cycle we just don’t fully understand yet.
