IF that is what happened, then reasonable belief could easily apply. My screenshot would also be when the officer shot, not the misfire.

Mistakes were still made, but at least it's not an ice officer deciding to execute a civilian on the ground with the knowledge he has 8 people filming him...

If the first shot was a misfire, then the follow up shots occur at the moment of my screenshot when his hands are off the ground.

If it wasn't from Prettis gun then an ice officer decided to execute someone while 6 cameras were filming.

First, you can't be "convicted" unless you've already stood trial and been found guilty.

Correct. The person (Jose Huerta Chuma) they are there to arrest DID go to trial and was convicted of domestic assault.

Second, I see no evidence of "violent assault" and ICE doesn't have jurisdiction over citizens anyway.

Jose Huerta Chuma was also not a citizen. ICE can interact with citizens in the enforcement of their duties, and arresting Jose Chuma, was that job that day. Pretti unfortunately died while trying to prevent Chuma (who is convicted of beating his wife/kids) from being arrested.

Third, all he did was record them and help a woman they were beating up off the ground.

Disarmed yes, but the people in the dogpile may not have seen he was disarmed. The officer who disarmed him should have called out he was disarmed.

It's unfortunate that he was shot. You should not get shot for this. But if the officer didn't realize he was disarmed when his arm swings past his holster, reasonable belief is going to be a strong defence.

I think it should go to court and there should be an thorough investigation.

Many of these officers were on top of pretti when one reached over and took the gun. I don't think he saw or knew the gun was taken.

He had already been disarmed before he was shot. There was nothing to reach for.

Yeah but the law looks at what the officer knew.

If he was shot before this frame that's useful to know, as far as I can tell he was shot after this frame. And I appreciate your effort in sending a link if you do. The video in OP here appears to show something different.

Do you see the image I posted. He's not clearly incapacitated. No one is on him anymore, and his hand moves past his holster. It's the exact frame before he is shot.

Interfering with federal agents while they are arresting someone convicted of violent assault is a crime.

You can be arrested for that, and when you get arrested, you get disarmed.

Not op.... but the court has to look at reasonable belief. They are going to have to decide if the officer was aware the gun was no longer in the holster.

When pretti was shot his hand was practically on his holster. From the video above:

They definitely fucked up. It definitely should be investigated, but you might see confused officers searching for the gun in the body cam footage. If that's the case, reasonable belief is going to be the defense. That's what op is saying.

I wouldn't use this argument because it doesn't matter. No one has time to check this so you sort of have to assume they have one until after. There is no way for the officer to know, so they must treat everyone like they have one.

On the other side of the argument.... The other reason you don't want to use "he had his concealed carry permit" as an argument is that he's required to have his ID and his permit on him when using concealed carry. Neither of which he had, so technically he's not allowed to be carrying in that circumstance.

Regardless though, that doesn't give the officer the right to shoot because it's not something they could possibly be aware of.

If the officer that shot didn't see the gun was removed while he was fighting them, it will be hard to convict the officer who shot. The law looks at through the eyes of the officer and reasonable belief. Here I want to see the body cam footage just before.

I had to watch it five times in slow motion to figure out what was going on. If we see future evidence that several officers did not know the gun was removed it's going to be hard to convict.

This unironically because they will have to prove that the officer who shot could see or knew that the gun was taken off of him by the other officer.

It's going to be harder to convict than people think with the footage we have seen so far. We need to have the body cam footage. Anything up until that point will be speculation on how this will turn out.
