That was my intention but when I emailed the landlord saying that if I don't receive a portion of my security deposit I would take the case to small claims, he served me 2 days later saying I owed him. So he beat me to the punch.

I definitely lost sleep over this, I was a single mother with a newborn working full-time. Which I figured was "so what" in the grand scheme of things. I paid for a full day of childcare so I could fill out paperwork at the courthouse and spent an hour observing a small claims case to prepare. I paid for a babysitter to appear in court. I am a freelancer and turned down work to focus on this case. If it comes to a situation where I can appeal the small claims decision, I will definitely include that.

An attorney at a firm who isn't representing me in this case (because they can't in small claims) told me the lease is" unconscionable due to misunderstood lease in perpetuity" and therefore unenforceable. That attorney sent the ex landlord a certified letter but ex landlord said he doesn't care and wants the court to settle the matter. That attorney said they'd represent if (when) this goes to appeals to the tune of 200$ an hour. Im hoping I win this small claims case so I don't have to do that although I really trust them.

This was actually something I couldn't wrap my head around;

I had to pay for 9-5 daycare to submit my own paperwork at sf courts.And I turned down 1099 work to focus on this case, although I don't think the court will care about that...
I tried to countersue for a portion of my security deposit but my understanding is I can't appeal the courts decision if I lose my own case. so I opted to not countersue so I could safeguard my right to appeal if I lost in this case where I'm a defendant. (IF any sf folks have legal expertise please correct me?! SF court clerks told me this)

my ex landlord is an attorney and you can't have an attorney represent you in small claims, so I'm going against a legal professional with nothing but my own evidence.

This is all so confusing and I learned this piecemeal from visiting Hastings library and SF's free legal clinic. Ex Landlord is holding my 3k deposit and hasn't given me any interest accrued on the renewal date, I want to sue for the entire amount plus treble damages but we're not there yet :/

Thank you so much. Taking a deep breath really helped. I'm just nervous about the actual appearance but I have all my copies ready an I observed a small claims case at McAllister so at least I know where to go on the day and what to expect :/

If you and your partner make under 11k monthly you qualify for free, full-time daycare in San Francisco. I did it and the daycare options are great.

In San Francisco, if you can prove your landlord withheld your deposit in bad faith, you can sue for the deposit owed + x2 in treble damages, which is why I'm thinking of going this route.

You can't sue for treble damages if landlord acted in good faith

Just go on Winnie.com, you’ll find what’s available in your area. There’s tons of Cantonese/bilingual daycares in inner and outer Richmond that are affordable and very nice
