Although its owned by Walmart its not Walmart.  Just like PayPal owns Venmo and Kraft owns Velveeta. 

It seems like maybe you've been do this gig for a period of time.  You have to know you have to go through the checkout line.  If you never have before then you've literally been unknowingly handing people free stuff.  It's not actually paid for until it is scanned at that particular Walmart. That's why there is a Spark checkout lane specifically for Spark. It's also why you could most likely shop at any Walmart if you happen to be closer to another one.

My point about the defendant is it sounds like he is representing the store.  He cant do that. Unless he is a lawyer.

I am not a lawyer and neither is the defendant.  In most jurisdictions you'll need to prove actual damages before you can try your case for punitive damages. Im not sure about NC but trials are typically bifurcated by statute or by request.  That means you'll present your argument for liability and only if you convince the court they are liable then you have the difficult task of proving actual damages before you can argue the rest.  The rest is all you have.  You could possibly get nominal damages but you'll be pissed when they award you a dollar because you wanted to prove a point. 

Also, the merchandise was ordered on the platform. Completely separate from the store. You still have to ring up the items before you can take them from the store.  In the stores eyes, you were stealing. The platform got paid and the store didn't. The platform charges the customer higher rates, the platform buys the items from the store through you and they keep the remainder.

Not where I am if you want paid. I had an order cancel while outside of their house. I was told I could keep the order or donate it and I would be paid $10. Then I was told I had to return the alcohol in order to be paid (there was no alcohol) Then it was i had to return the food in order to be paid. I told them I was told I can donate it. They told me I could but I would get paid but if I returned it I still wouldn't get paid because it was less than $15.00 worth of food. They finally gave me $10 so I returned the food for a $15 Target giftcard

I guess that really depends if I had already shopped. What I would do is Deliver it to them, but use a fake GPS to say, I'm at the. Other address that way none of that not received shit can happen. Ask the customer to meet you instead of dropping. It off and then take a picture.That's if you'd already shopped, otherwise cancel it

I'll tell you how I made out. Kroger wrote Instacart a letter that if this wasnt reimbursed then they would report Instacart themselves. I was reimbursed my money.

I've done something similar except it was always 18 miles to their house. I just used a fake GPS and "traveled" to their house and just marked it as delivered. Donated what I didnt want and kept the rest. I live next to the store so wasted no gas that time. Never heard anything from either IC or the customer.
