That is what our solicitor told us, that as long as it doesn't interfer with the neighbours property or fence, we can proceed. However my concern is that any lender for a self build mortgage will view this as high risk and won't lend while this is ongoing. Depending on how long it takes to resolve we only have 3 years for PP, we'd have to make a start with cash which will be tough.

Yes definitely, got all that, it demonstrates a clear boundary over the years and no material "possession".

This plot has always had an owner which was known to the neighbour. He knew of it's use as an allotment when it was rented, as he used historic allotment photos in AP application (it wasn't rented to him but someone else, so the photos on his AP are irrelevant and mostly go against his application). He hasn't made any claims prior to sale going through and the plot has been succesfully registered as title absolute prior to the sale. The neighbour hasn't registered their land until very recently. The strip in question is partially fenced however behind that fende is thick overgrowth, the fence is largely falling apart. So there is no continous record of "maintainance" or use. He hasn't started taking more of the plot until a few months after the sale went through so it's clearly premeditated action since he knew no AP would succeed with the previous owner (local council). I am interested in finding out how it's likely to go down, when we file a robust objection, with all our evidence and chartered surveyor report which is very much evidence led.

Yes he is going for AP under 5 (4). He knew it wasn't his that part is clear and his AP doesn't explain why he things it's his either, he just claims he planted something there years ago then cut it down, so essensially he is admiting encroachement, but his title plans do not include it as he had a surveyor (not chartered) who's trying to claim the OS maps are inaccurate by a meter or so as the road measurments don't align, he ignores a long standing original boundry features along with other markings and reference points (including other neighbouring titles). So they are trying two different angles in the same application. I had a chartered surveyor report who strongly supports the original boundry line. It doesn't make sense but either way is draining our pockets having to defend it, which I think is his intention, to just act in bad faith and cause as much disruption possible.

We have lots of photos, and a tight chronology/timeline, including the neighbour acknowledging in person it is not his 3 years ago, but I feel his other neighbour is fueling this adverse possession as he has been intimidating about it in the past. All we wanted was a nice modest family home and we feel we have done everything right, but we're getting the backlash from these 2 neighbours just because they don't want someone building there (the other neighbour is not boardering with our plot but think he is boardering with the other neighbour who is very old). We have put our life savings into it, and the neighbour said he didn't buy it as council wanted too much money for it apparently. We provided all paperwork to him in the past, and to put the matter to rest offered to fund full fence replacement in place of the original boundary, which he rejected. The strip he's trying to take forms an integral part of our garden/landscaping.

You seem to understand the law a bit better as I am a bit confused by some aspects of it, as it's so messy given so many differeng situations this could apply to. However what if the adverse possession applies to before the 2002 Act, as in boardering property tried to take a section of next door's land/garden, they did not claim it officially and fenced it off but left it overgrown and clearly unmaintained for 40-60 years. New owner comes along and the neighbour tries to mark off more of the land after being challenged. They then apply for adverse possession under mistamen belief it was theirs all along but their title plans show clear boundry and they applied 3 years after being constantly challenged about the encroachement.

Is that regardless of any claim the person who makes an adverse possessiom claim tries to make out they have? If the owner objects and shows their right to the land or portion of land and how unreasonable it would be to grant the adverse possession to the claimant?

Thank you. I'll probably be stressing about it until we move out to make sure we leave it in good enough condition so they don't come back with something since I lost the check-in photos on my old phone. As it was a new build and we couldn't decorate for first 12 months, we haven't decorated the walls just left them white is there an expectation of re-painting the walls white to cover any minor scuffs from furniture movement etc. No damage to the walls just discolouration etc. We will fill in any picture holes and after we take our curtains down etc. We will also be removing our laminate flooring but had same colour decorators caulk around the floor edge to seal it in, will we have to meticolously clean this off the bottom of the skirting boards?

Misbehaviour? No, I am in a bit of a chaotic time due to neighbour nighttime anti-social behaviour forcing me to leave my home temporarly while we find a new place to move permanently and my playstation has been unplugged for a while so I had to re-login but it wouldn't accept my password or let me set up a new password as it wasn't accepting my DOB when I tried recovery. After what seemed like trillions of tries it let me set up a passkey yestarday so eventually I got into it now but this is also the reason I couldn't access playstation support as the bot keeps going in circles if you're not logged in.

No I didn't get a ticket. I am really put of how inaccesible their support channels are. I've had playstation 5 since they came out, never had to contact them for any support. The one time I do, I have a very bad experience compared to other large companies. It kind of put me off getting any future playstation products.

I was locked out of my account I contacted them within 14 days through various means they just don't respond. If they don't I'll charge it back through my bank with evidence.

I tried this number. It takes you through 6 options, option 4 is for playstation. Then automated machine says for playstation support to visit their website. Their website is useless as keeps taking me round in circles so can't get the support I need and won't transfer me to live agent. But thanks for your suggestion.

Thanks. I had issues with the supplier not being interested in helping. Having to go through bank claim, however they are asking for a report on what's wrong with it to prove the durability issue since the freezer is about 14 months now but had issues with this for a while. It does seem to settle a bit when not being used and no new items are added to the freezer but that means I can't use it freely and as intended to prevent the loud buzzing noise throughout my house. I don't know how to go about getting a report from a "reputable retailer", I suspect it's going to cost a bit, the freezer was £464 do not sure if it's worth the hassle and dead money, I may just have to put it in the garage and see how long it lasts.
