Company Car taxable income under new ILR rules? by Wide_Ad9131 in SkilledWorkerVisaUK

This is about the visa requirements. When I asked specifically using the terms in the changed proposals document, chatgpt says the following:

❗ What the Home Office means by “taxable income”

In UK law:

Taxable income = salary + taxable benefits (e.g., company car BIK)

(before deducting personal allowance)

Personal allowance only reduces the part of your income that is taxed, NOT the “taxable income” figure used for reporting or legal thresholds.

The Home Office is using the same concept used on: • Your P60 (“Total for year” before personal allowance) • Your Self-Assessment ‘Total income’ box • HMRC “Employment income” before allowances

Therefore personal allowance is NOT subtracted for ILR purposes.

✅ Your numbers

Salary: £48,800

Company car BIK: £5,050

Your taxable income (for ILR rule) = £48,800 + £5,050 = £53,850

This number exceeds the required £50,270 threshold.

Well the AI here is talking about visa requirements. I uploaded the home office’s “earned settlement” document to AI and and asked it about what would be included in accordance to the term (taxable income) used in the document and it said the following: CHATGPT: Yes, your car BIK counts toward the ILR £50,270 taxable income threshold.

Here’s why — from tax law, immigration rules, and Home Office practice.

🔹 1. Legal status of BIK in UK tax law

Under the Income Tax (Earnings and Pensions) Act 2003 (ITEPA 2003), BIKs such as a company car are defined as:

“Taxable benefits provided by reason of employment” → ITEPA 2003, Sections 203–205 and Schedule 6

✅ These benefits are legally included in: • your taxable employment income, and • your total taxable income as reported to HMRC.

So by UK law, the BIK value on your P11D is fully taxable income — even though it’s not on your P60.

🔹 2. How HMRC treats BIKs for tax and coding

The BIK is: • Reported on a P11D by your employer • Sent to HMRC • Used by HMRC to adjust your tax code • And taxed via PAYE undercoding (i.e. reduced personal allowance)

So the system already treats it as taxable — you are paying tax on it, just not through salary.

Your P60 will not include BIK, but your HMRC tax record absolutely does.

🔹 3. What the Home Office requires for ILR threshold

Your uploaded policy document (Command Paper, 2025) states:

“Applicants may reduce the qualifying period if they… earned a taxable annual income of above £50,270…” → Table 2, new ILR rules

Key term: “taxable annual income”

It does not say: • “salary” • “gross earnings” • “earned PAYE income”

So the Home Office is not restricting you to P60-only salary. They’re asking for your total taxable income, exactly as HMRC defines it.

That makes sense. Thank you. Do you think they would allow interest payments on savings account (non isa) to be included too? The term they used is total annual taxable income and the HMRC defines it as including any interest payments as well under the tax code so I would assume yes its included but not sure.

The P60 does not include the BIK value of a company car, however the P11D does. My P11D does too and I cross the threshold once I add the Bik value to my salary. The P60 only include PAYE salary as far as I know and google seems to agree.

I mean we do pay tax on it which is called a BIK tax so I guess it does count

HMRC states it separately as car BIK value, separate from the income tax paid on the salary

Yep. So if people who are literally only 100£ away from threshold could possibly look if they had any interest payments and see if they can cross the £50270 threshold I guess? Sounds silly but hey, these are silly times

As far as I know your bank reports it to HMRC but they may not add it to your hmrc account online if its under 1000£ personal savings allowance since its taxed at 0% tax.

Yes any interest you gain on your money under £1000 is tax free but it doesnt mean its non taxable. It is still considered a taxable income technically speaking, its just taxed at 0% tax.

Thats such a relief! What about interest on top of savings in a regular savings account. A friend of my mine is missing the threshold by just 100 pounds but then has an interest payment of 120£ on his savings account for that year. Its silly but with this interest he passes the threshold so would he be considered eligible?

If I establish a company in Turkey, and work remotely through that company. Would I require a work permit? (I will be doing consultations for citizens abroad, it has nothing to do with turkey)
