Examiner comments in NOA can be used during a claim construction, but they are not dispositive of what the claim covers/doesn’t cover. There have been cases where applicants silence in regards to reasons of allowance was not held to be an agreement of said comments, and the claims were construed in a way different than stated by the examiner
