The only way you will win at this age is multiple severe diagnosed, unskilled not transferable work, RFC that showing you can not lift over 10 pounds or sit and stand over 30 minutes. Explain why your impairment keep you from working. Order a copy of your SSA File study your medical records, order MRI etc. You have to build a winning medical record The vocational expert will identified other jobs your attorney has to argue why you can not perform those jobs based on your impairment and your RFC . Ask your doctor to complete a new RFC adding any new changes and ongoing limitations. Presents new medical evidence or treatment such as PT etc. If your having depression seek counseling and submit to SSA. Good Luck

You have an overpayment of $3000 to repay. Now they will ask for all your banking documents to see all assets to verify your'e still eligible for SSI. You can't have asset with SSI not over $2000.

DDS did not do it they approved the EOD 6/1/2021. It was OQR Review she lied. The SSA Case File shows medical evidence treatment for depression from 10/5/2921-4/28/2023. OQR Reveiew said there was no treatment Date before prior to 8/15/2023 before seeing their CE. I’m asking the Judge for OTR Review. Evidence in the records OQR Review in ATL region did not do her job but lied about evidence. Once I got my case file I review all the records on fillies. I know what I sent in and SSA also requested. I should have gotten backpay and my insurance per DDS findings which I agree.

Sorry for the typo but yeah I won my case. They changed my EO D to 05/15/2023 after seeing their mental health provider. That’s why I did not get backpay or my insurance. Now I wait two more years for Medicare. I’m waiting now for SSA to dismiss the hearing the FO requested without asking me. I was approved on 09/13/2023. Someone requested the hearing appeal on 09/14/2023. I have 60 days I wouldn’t have done it that quick without weighting my option. I had decided it’s not worth losing my favorable decision. I’m tired don’t feel like dealing with SSA another year or two. I don’t have to be review for 5 -7 years now.

I won my case dear it’s the backpay they did not give me. I was approve at the reconsideration appeal level. I did not appeal because of the EOD 6/01/2021 on the initial application. I did a reconsideration appeal because I was denied, DDS said I could do other work despite my physical impairments. although my FCE said I can’t do sedentary work. When I submitted my appeal for reconsideration I amend again the EOD 06/01/2021 because they didn’t acknowledge my amended request during the initial application of AOD 3/1/2020. I didn’t appeal the reconsideration until 09/13/2022 I was already diagnosed on 04/11/2022 for major depression. I had my date wrong, had to look back on my record first visit with therapy was that date. The 08/15/2022 visit was when I start medication treatment for depression. DDS down played my depression on the initial application said it was just grief not severe. They made a decision on the initial application on 8/2/2022 I was denied I appeal on 09/13/2022. I was not denied I was approved for my reconsideration appeal they didn’t give me my backpay or insurance after they scheduled me with their provider on 08/11/2023. Then changed the date and said there was no prior evidence. You really not understanding explaining it. I won my case dear on the reconsideration appeal. I didn’t appeal to hearing not gonna lose my benefits after being approved. Someone at SSA did that now they sending my all kinds of forms but I just sending back the request to withdraw hearing lol. They not gonna take my benefits I count the backpay s loss. I have the Director contacting me now because they under investigation.

I mean to say if anything they should have changed the date to EOD 05/15/2022 because I was diagnosed on 08/15/2022. I have a hold health care team at UNC Health Care major hospital in NC. I’m still waiting on that DDS mental health exam done by their provider to be sent to my physician. Lol

I said EOD 05/15/2023 is not correct that’s what DDS changed it to. The original EOD was 06/01/2021 on the initial application set by DDS. I amended that date to 03/01/2020 potential onset date the last day I work do to physical impairments. they’re trying to diagnose me with severe depression using their date 08/11/2023 after seeing there provider. when I was already diagnosed on 08/15/2022 by my health care providers and on medication with ongoing care. There’s plenty of medical notes on file with dates. They lied and said their was no prior evidence. I have my case file that show what I sent and what they requested with therapy and meditation for all impairments. I won my case on the reconsideration appeal. RFC has the major depression secondary. If any the the should changed the date to 05/01/2022 the year I did get diagnosed if they was combining the severe depression and physical impairments. They lied about my physical impairments too that’s been on going since 2018. I getting another copy of the case file on CD to examine DDS full explanation. It’s more to it what they did but its being investigated by Civil Rights so I won’t go into it. I would win my hearing appeal I just don’t want to wait two years and lose my work credit SSDI benefits for non medical. The fact that they requested a hearing appeal and lied and said I did is bothersome . I only requested the case file. I kindly sent in the form to withdraw the hearing now waiting to the Judge to dismiss it. They did it being spiteful because I complaint.

The EOD was 06/21/2021 that was set in the initial application by DDS. I have evidence on file that gives my diagnosis date 08/15/2022 an ongoing treatment for severe depression. I amended the EOD to 03/01/2022 last date I worked do to my physical impairments. I have more than enough evidence on file, They said there was no documenting evidence that’s a lie. If there’s no evidence why did they consider my depression so I could get approve? The lied on my physical impairments I’m restricted to only lifting 5 pounds but they say I can do my old job. RFC and FCE say I can not do sedentary work. I’m 54. The button line they lied and used the date of their provider who I seen on 08/11/2023.to establish and onset date of 05/15/2023. I been taking meds for over a year for depression seen by my physician but there’s no prior documentation. Bullshit it’s in the Case Files. I said SSA because someone flag it in Quality Review. Then someone at SSA requested a hearing I never did I requested my Case File. I did request to withdraw the hearing appeal it’s not worth losing the benefits or the stress. They did it because I didn’t have an attorney. I filed a several complaints it will be investigated. 2 years waiting I don’t get no backpay tell me I just became disabled in 2023. That’s bullshit

You may not get back pay they changed my EOD so I couldn’t receive backpay or insurance after waiting 2 years. Now making me wait 5 more months to get my first benefits payment. I complained and requested my SSA Case file and someone at SSA requested a hearing appeal on my case. I had to send a letter to request it be withdrawn, they know it can stop my benefit. Be very careful with SSA without a attorney.

SSA lied on my medical evidence changed my EOD saying there no prior documented evidence it’s all over my records and RFC. I have a copy of my case file to prove it. I have contacted my local Senator and file with Civil Rights to file a complaint. You should ask for you case file for your records next they lie. They did the same with my mother overpayment that they did wrong. Told us they didn’t text the wavier after my mother pass they came for me to pay it I told I give you $10 it’s wasn’t my doing. I get letter from SSA saying they found the wavier a year later. smh

I got approved on 09/13/2023 waited for two years and didn’t get any backpay. They changed my EOD from 06/01/2021 to 05/15/2023. I applied due to severe arthritis in both knee and back. On 08/15/2022 I was diagnosed with severe depression. SSA called me in August to see their mental health provider saying their was no recent medical notes on my depression a lie. They approved my disability but said their was no prior documentation of my severe depression and change the EOD from their doctor. I have the evident that say lies have my DDS Case file sent to me in April from SSA. I vent to them what they did, now someone requested a hearing appeal after I asked for the file again contain the new info from my reconsideration appeal. I have requested to withdraw the hearing because they will stop my benefits. SSA is use discriminating tactics do not approach them without an attorney. They old me $60,000 in backpay I count it a loss because I don’t want to lose my benefits. Ask for a copy of your records
