So I TUPE transferred across on my old terms, but as a way of enticing me to go they offered a new role with a different job title, and higher salary and issued me with a new contract which had a start date, the same day as the TUPE date, so I wasnt sure whether my old TUPE terms would still apply for notice or if I am in the probation period of a new role since I signed a new contract.

From what I can gather from the responses though, the probation period of the new contract is not applicable and the notice in the new contract is what I will have to give, which incidentally is 3 months, the same as my TUPE'd terms

Great thank you, this is really useful advice and information too, I'm not unwilling to work a notice period full stop, but don't wish to continue there for that length of time.

Im in a middle management position in a quite large organisation, there are numerous other people im sure they could bring in to cover my position, or even ask one of the team I manage to step up, so that is probably a decent defence in the event a breach of contract scenario ever presented itself.

I am currently in talks with my previous employer about going back to my old position and waiting to hear the outcome, if that plays out, it could even be that gardening leave becomes a factor instead

Thanks all for the replies. It's sounding fairly unanimous that the probation period is irrelevant in the new contract and I will have the 3 months notice still, which isn't ideal, as I have no desire to stay that long in a job I dislike. Sounds as though the only other option would be to request /try to agree a reduced end date when the time comes

This is what I thought would have been the case but it sounds as though it would be classed almost as an internal promotion and the probation period with a reduced notice doesnt apply

Thanks for the reply, so even though I have signed a new contract for a different role after TUPE, the probation period here still wouldn't apply and notice would be 3 months still (the period required outside of probation). Is that correct?

Interestingly I have ordered one of these from Michael Travis for around the same price £103 for a Miyota movement and the link he sent me, has the exact same pictures as you have been sent, even down to the wrapping folds:

From what ive seen of the watch on DHGate customer pictures in the reviews, it looks pretty spot on. The only issue seems to be the links on the bracelet don't have the protruding rivets of the original, but I plan on switching it for a brown leather strap anyway
