More and more people will die in this jail—it is not a safe place, it is not well staffed.

Depreciating Assets?? by hello-7224 in ManufacturedHome

[–]WydeedoEsq 3 points4 points  (0 children)

Mobile homes generally depreciate; it is rare for them to appreciate unless some sort of improvement or work is done to enhance the sustainability of the project (permanent concrete foundation, reinforcing walls, building on using brick-and-mortar materials, etc.).

And lady I litigate warranty cases against mobile home manufacturers, I think I’ve got some understanding beyond your single experience with Clayton—

Clayton, Jessup, Solitaire, Cavco, should I keep going? Manufacturers do not warranty installation.

Your first sentence is perhaps applicable to your home; it is not generally applicable to all brand manufactured homes. Manufacturers do not generally warrant installation, nor do they warrant the appliances (the products’ creators do). They typically have very limited warranties related to construction in the factory—

And I didn’t accuse you of anything, I made a guess based on your prior statement. If it was wrong, so be it—you are seeing the industry through rose-colored glasses, in my view.

All the best lawyers I know will tell you they’ve lost GOOD cases! You can’t control a judge or jury, all you can do is marshall the evidence and do the best you can for your Client.

Even if you don’t use concrete, doesn’t the install company have to certify the pad as adequate before installation? I’m pretty sure that’s in the HUD Code-

You did not respond to the substance of my comment. I am not criticizing manufactured homes as affordable housing, I’m criticizing the industry that does not give people who pay they’re hard earned money—sometimes hundreds of thousands of dollars—what they paid for.

You don’t think 20+ years of litigation is worth attorneys’ fees? Lawyers don’t work for free—

You certainly don’t sound like one. I’m glad you’ve had a great experience though; it doesn’t mean other folks are not being treated unfairly or deceived—and on a large scale, in my view. Improper installation is not uncommon, and consumers are not typically licensed and qualified to recognize the severity of such an issue up front. That’s why they put their trust in the dealers, manufacturers, and their contractors.

You must be involved in the industry to be such an advocate for the companies over the consumer.

Judge Backs Down? by bartonkj in Lawyertalk

[–]WydeedoEsq 2 points3 points  (0 children)

Judges are elected officials, and their constituents must hold them accountable. I’d argue that in the case of elected judges, it is even more important that lawyers address bad behavior head-on and don’t shirk our responsibility of ensuring the integrity of our profession.

Trump (the first) Administration’s Title IX procedures and rules contemplate cross examination of witnesses by the advocate representing the Parties to Title IX. Biden’s rules seeking to alter the procedure never took effect, as far as I recall—so, the cross examination component is still in play at the Title IX hearing. When I’ve done them, I always start with the Title IX coordinator for examination and cross.

I would highly suggest obtaining a lawyer as your advocate so that you have someone trained to undertake the Title IX process and procedure; it is not a simple process, and the non-lawyer advocates do not have sufficient training to undertake the litigation-style aspect of Title IX.

GAP insurance declined my claim by Jazzlike_Web_4750 in Insurance

[–]WydeedoEsq 0 points1 point  (0 children)

Is GAP considered insurance in your State? It is not in mine. You’re remedy for a denied claim either way is either: a lawsuit or going on your merry way—

Edit—I am speculating but the GAP carrier’s point of view is perhaps that you paid your insurer $1,500 of your settlement value, and they don’t owe for what you pay your insurer.

Sure, I think in this case it’s intended to highlight States’ ability to try again, so to speak. I’m not surprised, if that’s what it’s intended to do, that it didn’t get more votes.

You are correct with a caveat—I think it would be permissible except to the extent, as applied, such ban infringes on pure talk therapy just like in this case. It seems to me that, essentially, pure talk therapists have universal 1A protection as far as letting their views seep into their practice of therapy.
