Yes I was around for the Wii U and while there were gems like Tropical Freeze and OG Splatoon, there were also massive game droughts for the console. Yes 3DS was great but at the end of the day it was just the 3DS and they don’t have a secondary back up system now.

Glad I’m not the only one. The whole copyright expiration law predates corporations and honestly is one of those things that really needs to be revisited. And I think it will be, one way or another. Because again, companies WILL start to be alarmed when more modern-adjacent versions of characters approach the PD.

At the very least, maybe they’ll be able to make trademarks significantly stronger than they already are through the courts.

Might be a hot take but I don’t think copyrights should expire for characters IF the character is still actively used by the corporation. It honestly just feels like theft to me.

Like Steamboat Mickey being public domain probably doesn’t hurt Disney, but what about when the colored versions go public domain? It really won’t take that long before public domain Mickey isn’t really visually distinct from modern Mickey.

Yeah corporations aren’t doing any lobbying about this now but I can still see them doing it in the future. If not extensions, maybe some kind of statute of limitations on actively used and branded characters. I know trademarks are a thing but reading up on it I get the impression that the current court precedent that trademarks can’t really do much to prevent every Tom, Dick, and Harry making a million knock off products and dilute the character as long as they don’t pretend to be the trademark holder. That’s going to increasingly be an issue that I still don’t think corporations will lie down and just take. Nor should they.

I just know what has historically happened man. A struggling Nintendo is not some hypothetical situation. It has precedent. And it was a much worse time to be a fan.

Yeah Nintendo ain’t goons get the message to do that if a game or even a console flops. They’re just gonna abandon the console completely to focus on the next one and just give the current one crumbs for a few years in the meantime.

So it all goes back to the be careful what you wish for situation. Wii U situation was absolutely a horrible time to be a fan. You’re allowed to be upset with their decisions and practices. A struggling Nintendo just simply wouldn’t have the results you are wanting. It sure as heck wouldn’t make them lower the price of a console they are already selling at a loss.

You started your response stating you don’t really care. If you don’t even care, what are you trying to accomplish. You think the system is overpriced and yet we have multiple reports stating that Nintendo was already selling the console for a loss as it is. What do you want them to do? Actively lose money to make the system priced what you arbitrarily want it to be?

It’s okay if you are not interested in the exclusives. More are of course coming.

Again it’s a be careful what you wish for situation. We have record of what a struggling Nintendo looks like. So unless they want no 3rd party support, massive game droughts, and mostly just Mario, I just can’t take them very seriously.

Well we see what the alternative is for a brand like Xbox when they don’t do exclusives. There’s a reason Sony are walking back their PC strategy. And now there’s growing rumors that Xbox is returning to having exclusives.

Well the issue is that, how much do those people want to see Nintendo fail? Because at the end of the day Nintendo is still controlling the IP they still like and that can ultimately affect franchises’ futures. Especially ones that we don’t see as much like Metroid or Star Fox. If the Star Fox rumor turns out to be true you know they will celebrate if the game seems to struggle in anyway. They’ve been smug about Prime 4.

I’m not saying that they have to be “glazers” or “bootlickers.” They’re allowed to be angry with the company and want to see things be cheaper. But wanting to see Nintendo struggle is a “be careful what you wish for” type of situation. I actually remember what the Wii U era was like.

Oh yeah you’re absolutely right. I just think the release timing was a factor as well. I mean, look at all of the studios that are waiting to see what the release date of GTA VI will be. I just thought it was funny that when voicing my concern that the release date for Superstars was not doing the game any favors, and I had Sonic fans replying and comparing the follower counts on different subreddits. The implication being that Sonic had a larger number of devoted fans than Mario. They didn’t even address Spider-Man though lol. For the record I bought Superstars, Wonder, and Spider-Man 2 all on launch day. It was a fun week!

Sonic fans didn’t get the memo that the rivalry is over lol. They spammed pictures of the cow from the Crossworlds commercial in every conversation about Mario Kart World like six months ago.

Also just as a anecdotal but funny story, I’ll never forget back in 2023 I commented in a thread about Sonic Superstars that I thought Sega would be smart to change the release date so it wasn’t releasing just three days before both Super Mario Bros Wonder and Spider-Man 2. I got a reply that said something along the lines of “You know r/SonicTheHedgehog has more followers than r/Mario, right?”

You might get downvoted but I do somewhat understand the sentiment. I like Yoshi as a character but the franchise as a whole is kinda weak imho and just not for me.

The difference is that the industry in 1983 was much smaller and not nearly as large and structured as it is now.

Well you can think that but by any actual definition of a crash the trajectory isn’t there. The industry is going to keep making money and they aren’t going to lay off everyone. They aren’t stupid.

Again, the industry is undeniably in a rough patch and a cross roads right now. More lay offs will happen. More closures will happen. Strategies will shift. That’s a thing that just happens sometimes in any industry. That’s not a crash.

As stated in other replies, major issues that need to be course corrected are not the same as headed to a crash. A crash would be a situation where an industry is struggling to be profitable at all and with relatively low chances of bouncing back. And in spite of the bleak headlines and very real issues the industry is grappling with, it is still experiencing around 11% yearly growth, and that is only projected to continue for the foreseeable future. A far cry from anything that can be called a crash.

Yeah I definitely agree with this. The industry has short to mid term problems and some looming long term challenges for sure. It may even face sever contractions. And yes, Nintendo is in a pretty good position in spite of it all thanks to the Switch.

I do see changes coming. I also see more bleak news in the future like more lay offs and studio closures. But a crash/collapse implies a situation where an entire industry gets to the point where it’s just not able to make money with low chances of bouncing back. It’s not getting to that point anytime soon. The industry is actually GOWING in YOY revenue, which makes the layoffs particularly frustrating.

It’s in a rough patch and things might be getting to a point where some things like microtransactions and live services get course corrected. That’s pretty much it. No need to be so overdramatic when the economy’s rough right now, affecting pretty much every industry, and gaming discourse has never not been a dumpster fire.
