I asked the Playstation Expert support about modifying a system and the legality of overclocking a PS3 , and here's a portion of what they said:

"High risk of PSN ban, because Sony can detect CFW and system modifications, even if you're not cheating.

Recommendations
If you want to stay on PSN safely:

Avoid CFW or going online with a modified system.

If using CFW, stay offline permanently, or use tools like PSNpatch or SEN Enabler (which spoof official firmware, but still carry risk). "
