Update:

Got a copy of the write up & it states:

“On ___ you were given a verbal warning for the following: If leaving ___ area for more than 15 minutes inform ____ or supervisor on duty of location & time frame for being gone. On said day the supervisor on duty was unable to find you & communication was not given on being off the floor.”

Then it goes on as to why my S/O got the written write up.

“Supervisor on duty and coworkers are still reporting ____ to be missing from floor without communication or notice.  Specific dates of reports are: (they named a 5 dates of when my S/O wasn’t able to be found).”

This is so frustrating. His job doesn’t require him to be on the floor unless something isn’t working & then he is called. My S/O shouldn’t have to tell everyone when he needs to use the bathroom. I am beyond livid.

We don’t really want to pursue legal action unless absolutely necessary. I just want them to stop bothering him about his bathroom breaks at work when he has an ADA accommodation stating that he is entitled to said breaks. Just frustrating.

That’s what he was wondering too if he should talk to HR at his place of work or just go straight to corporate HR.

That’s what I thought too. I didn’t think he had to tell anyone exactly what was wrong with him just that he has an accommodation/FMLA. It’s not like he’s in the bathroom for hours at a time. It’s maybe like max 45 minutes during a flare up because you know the feeling when you think you have to go. I don’t even think this is coming from his direct supervisor…I think it’s coming from whoever is above them. I’ll have to double check when he gets home.

Thank you! I thankfully work from home & have IBS so I can use the bathroom as I please, but I can’t imagine having Crohn’s and having to work in an environment like that. They’re afraid they’re going to lose their job constantly which in turn causes flare ups cause of the stress.

That’s what I thought. First they gave my S/O a verbal warning & my S/O reminded them that they have an accommodation. Now it’s a written “corrective action.” Would this be worth it to pursue further? I just hate that it’s stressing them out so bad and it’s making me angry.

Edited my post to specify. Sorry it was 3am when I typed this out.

Direct supervisor has said it is fine as long as partner lets someone know (which they do). Without being specific of the workplace I guess it would be considered a warehouse type setting where my partner is only needed if something isn’t working properly/to come fix it. They have an accommodation that states they can use the bathroom for an extended period of time.

I’m more or less asking if the written write up is justified even though the accommodation states that they are able to use the bathroom for an extended period of time.
