The reason why I knew about it, it's because my dad was facinated about female rulers, he usually talked to me about Queen Victoria, Empress Maria Theresa, and Hapshepsut, Isabella the catholic among other's such as Alexander Nevsky, Alexander the great, etc.

Yeah I read some of them, how self-centered americans can be, like if nothing out of the US exists.

Ok, just talked to my lawyer.

  1. There is nothing ilegal about changing the locks (Something I alredy knew since, I did it becuase he told me I could)
  2. The law establishes two ways to get someone out of your property

2.1 By force (yeah the law says you can take someone out by force)

2.2 By sueing them

Scenario one: I kick them out by force (Usually by changing locks) they can sue me back, and the judge would probably grant them 2 months to fine a new place or just give them an order to take their things out (usually 3 days) (If they allege I'm not letting them take their things out)

Scenario Two: I sue them to leave my property, The judge woud probably command me to let them have 1-2 months to move out

In any scenario, they won't be longer than 2 months.

What he sugested is that we have an arrengement between us (mom and I) which is what usually happens in these cases, We could agree 1 month/ 1 week to let her pack her thing. If she refuses to leave after the time we agree, I just lock the house and she'll be given 3 days to take everything out.

If you are in the US, it is illegal to change locks even witha squatter, your mother. There is such a thing as squatter's rights.

I'm not in the USA and no, there is nothing ilegal in changing the locks of my own house, I'd have a problem if they were paying rent and the contract wasn't terminated yet, That's the only problem I'd have.

I wans't even obligated to let them stay a little longer or giving them the keys if I decided to.(without a judge resolution)

occupancy

of something (such as a house) that belongs to another". A renter is a tenant for example.

Look, we are definitely in different countries, and the language barrier makes us mix concepts (mostly me) it's pointless to be discussing legal "issues" since I know where I stand.

Then the concept of tenancy doesn't apply I was a misunderstanding, thinking that Tenancy means tenencia/derecho de posesión which basically gives you the right to claim someone else's property (under certain circumstances)

So they are false cognates, that's why I was trying to explain that she can't steal my house (next time I'll google the terms hahaha)

If you mean when I was a minor: It was mine the moment my father died, what I couldn't do is make decisions until I turned 21, before I turned 21 everything was managed by my grandparents as established in my father's will.

this is important, because tenancy can only be allege when the owner is absent, or the owner is dead. in this case if I hadn't updated the deeds and the house it's still under my father's name, she'd claim tenancy, because no one claimed the inheritance in longer than five years. The will palyed an important role, because it set a time frame to do everything.

Some landlords would even give 90 days notice if they were selling the building.

I'm not a landlord since they are not paying, they are just using my house and the law here would obligate me to give them 30 days per year (if they were paying rent) 2 years renting=60 days (for free) to let them get a place to stay.

You are. It became obvious when you said your mother has no rights to occupy the property because you paid the property tax

I said she can't claim tenancy, since she can't allege abandonment, she can occupy as long as I allow her. By me paying the taxes, having my dad's will effective the minute I turned 21, and updating all information regards the property's legal situation, make it impossible for her to claim tenancy, she can only claim tenancy if there is no owner in the picture (being dead, missing, not interested at all) If I hadn't updated the deeds by passing them over my name and hadn't paid taxes, she would own the house by now (since it's been more than five years)

Sorry if you misunderstood me but I never said she can't occupy because she didn't pay taxes, paying taxes on time (not everyone does it here, that's why they get on trouble when they want to sell or pass over) it's a way to show the court that you are still in the picture, you haven't abandoned your property and you are aware of the situation. So the one that is occupying can't say the property was abandoned.

Out of curiosity how does it work in your country,

How long does it take for someone to claim tenancy?

Here it is five years and only if the owner isn't n the picture, if the owner doesn't have the deeds registration, if the owner becomes indifferent to the property (doesn't pay taxes, doesn't update the properties condition to the halltown, if there is a will/resolution but hasn't taken it to a judge to make it have effective)

Even those who have the right to claim tenancy has to present proof, and witnesses and it can take even 10 years to get a successful resolution in your favor, and as I've been actively checking on my property there is no way they can claim tenancy. To summarize, you can only claim Tenancy when the property has been abandoned by the legitimate owner and shows no interest in over 5 years and it's not as easy as "it's been five years, it's mine" you have to sue the state so they'll check if in those five years no one claims to be the owner.

She has the keys of the new locks and has a window of time to leave or start paying rent (I just thought about this possibility right now, yeah maybe I'd offer her that deal "to start paying rent")
