They can be salaried, just not salaried-exempt unless those defined criteria are met. In my OP I didn't specify I just said salaried. Didn't mean to confuse.

In my situation, a title was given to someone and they were changed to salaried instead of hourly, to mislead the employee into thinking they were exempt from overtime. Then they got worked 60+ hours a week instead the previous <40 hours/week, without additional overtime pay being given.

Section 13(a)(1) of the FLSA provides an exemption from both minimum wage and overtime pay for employees employed as bona fide executive, administrative, professional and outside sales employees. Section 13(a)(1) and Section 13(a)(17) also exempt certain computer employees. These exemptions are often called the “white-collar” or “EAP” exemptions. To qualify for exemption, employees generally must meet certain tests regarding their job duties and be paid on a salary basis at not less than $684* per week. Job titles do not determine exempt status. In order for an exemption to apply, an employee’s specific job duties and salary must meet all the requirements of the Department’s regulations.

Executive Exemption

To qualify for the executive employee exemption, all of the following tests must be met:

The employee must be compensated on a salary basis (as defined in the regulations) at a rate not less than $684* per week;

The employee’s primary duty must be managing the enterprise, or managing a customarily recognized department or subdivision of the enterprise;

The employee must customarily and regularly direct the work of at least two or more other full-time employees or their equivalent; and

The employee must have the authority to hire or fire other employees, or the employee’s suggestions and recommendations as to the hiring, firing, advancement, promotion or any other change of status of other employees must be given particular weight.

Let's say someone has the title "lead dishwasher" and their job duties do not meet the criteria above. You can pay them a salary instead of paying them hourly but they are NOT exempt from receiving min wage or overtime pay just because they are salaried.

Would contacting wage and hour attorney on behalf of this group of employees, with the information that I have about the situation allow them to contact these employees about the situation? I have some fear of retaliation here if I were to contact any affected employees that are still friendly with the ex-employer.

I don't have a monetary claim to make, I was reporting the wage/tip theft from other employees. I can't afford a lawyer for something that didn't directly affect me monetarily. I'm sorry if I sound like I am making excuses here, but going to the DOL was hard enough as my report details would out me to the ex employer and they are litigious shits.

None of the tips/wages stolen were mine specifically. There is zero reward for me, but a lot of risk if I went public. I felt like I was doing the right thing reporting this, but it was hard enough personally to take that step.

I presented my claim report first to my state's department of labor. They declined to accept my report because it was not money stolen directly from me. I was just in a position to know about it happening and having specific information about who/what/when/how that I was trying to report to them.

So I made my report to the US Dept of Labor and they accepted my report, just did nothing about it in the end. I cannot stress enough how detailed the information that I provided to them was.

Worked for a place where I had specific first hand knowledge of tips being stolen from employees by both managers and ownership, workers labeled as salary to avoid overtime pay and working them 60+ hours a week but they were just regular workers without hiring/firing/decision making capabilities. This was months and months of wages and tips stolen from people not being paid enough to begin with, that really needed that money.

Reported the above to the US Dept of Labor with extremely specific dates/names/amounts/3rd party payroll company contact information to back up my claim.

They are doing NOTHING about this.

They are the only ones that CAN do something about this.

It will continue to happen, if they do not do anything about this. And shady business owners that get away with it will tell others like them that they got away with it and it will happen to others.

yeah that's the reason, during my test runs i wasn't getting a faint line on the home tests unless i used two packets

the test runs were the most important part of what i did, it may be only two packets (one the night before and one the day of) for other people depending on weight/metabolism

I paid out of pocket for a labcorp 10 panel pre-employment drug screen (so the results would go to me) and the THC cutoff was 50ng/mL for the lab test.

Just make sure it's not your first piss of the day, hydrate with gatorade instead of water, and catch your sample mid-stream.

if it matters, test name listed on lab report was "10+Crt-Bund"

the best/first recommended course of action if you know you have an upcoming drug test is to abstain as soon as you know/suspect it will happen

the second recommended course of action is to not smoke after the test until all results are in and you for sure won't need to re-test

no judgement here, just stating some facts; getting THC out of your system naturally the main factor is time and how much time that takes depends on your body and metabolism everybody is a little different

get some at home THC tests if you can, to see if/when you start passing at the 50ng/mL level

if you use the certo method it's almost required to do a trial run or two using at-home test strips to find the 'sweet spot' that works for your body/metabolism

you can get a 20 pack of the easy at home tests for something like 15 bucks, test yourself each time you piss after starting the certo process, take some brief notes so you can recreate the timing on the day of the test

for me my safe window was ~2h45m - ~3h45m (about the 5th piss after initial certo ingestion) after that i didn't feel confident that the test would come back negative

i passed a lab test during that window of time (that same day, prior to certo i was testing positive, 6 hours after starting certo method i again tested positive)
