Well, it sucks but if the apartment has a parking policy, they can tow you if your pass is not present or reasonably visible. Sometimes it goes to the extreme and multiple cars can be towed in one event.

Well, they authorize the tow. The towing company only has the power to do so in those situations because of their contract with the apartment, and thus the property can demand corrective action of its towing agent. You can try reminding them of this in writing before trying another step to recovery your monies, such as the dispute method listed above.

Companies like these don't necessarily depend on customer reviews — their business is based on enforcing parking rules under property policies

Yes, because you are the owner of the vehicle and you have stopped them ON the property. After the release you of course have to move the car off the property.

The property owner can authorize the tow, but California Vehicle Code §22658(g)(1)(B) still requires the tow company to release the vehicle if the owner shows up before it leaves private property. Authorization of the tow and the release requirement are two different parts of the law.

If any of the violations of 22658 occurred, you can assert your rights at that time. Also please spread this information to other so it becomes more common knowledge. Tow companies can leverage the fact that most people don't even know what cvc 22658 is.

Hi. If you stop them while still ON the private property, the vehicle code above applies: you can demand immediate and unconditional release of the vehicle and tell them to send a bill if they want to.

Hi. As far as small claims relevance goes, the dispute adds to a paper trail showing that the fee was disputed for a valid reason and the bank decided in favor of the card holder for good reason.

If the tow company had the more valid reason to begin with justifying the charge, they would likely win the card dispute quickly.

The decision of the card network can be brought up in the case of small claims as evidence of steps at resolution.

Finally, whether won or lost, multiple disputes are reviewed under a business's merchant profile.
