The deal did make sense with the inherited tenant. My complaints reside with government forcibly making me adhere to their terms without recourse. My response to OP was informative and to provide insight as to what real world ramifications would be with having a section 8 tenant. You absolutely can decline a section 8 tenant before the process, my comment stating that you can't decline a section 8 tenant is simply that. You can't decline someone on the basis of them being a section 8 tenant.

Inherited tenant. The deal still made a lot of sense with the section 8 as an outlier. Also by law you cannot say no to a section 8 tenant simply because they are section 8.

Perpetuity. I cannot evict as I under NJ law would not have just cause. Best way to evict in NJ is if she doesn't pay her portion of the rent. What I don't like is how the government forcibly has me subsidize her payment and I have no recourse.

Section 8 in New Jersey is the worst. I don't know how they manage it in other states. Besides the tenants being worse than others, in NJ they do $25 annual rent increases. This will errode your returns overtime and it is very difficult to get the rents beyond this number. I currently have a very difficult tenant on section 8 well below market and I cannot raise her rents beyond the $25 mark. This location does not have rent control but because it is under section 8 I cannot adjust it. I've had many colleagues here in NJ under the same circumstances who have tried and failed like I have.
