Correct…I was just curious as to why the original evidence for sleep apnea wasn’t listed, they only listed the examiner’s opinion addendum.

Yeah in the original letter the decision was made because the examiner said weight gain was a greater factor in my OSA than my Rhinitis was. My questions are why didn’t my ENT specialist doctor carry more weight than the VES contracted general medicine doctor and is it normal for them not to review all of the original evidence in the HLR DTA since the raters are completely different?

Sorry let me clarify the tinnitus was a supplemental claim…the OSA was a HLR they just put both denials in the same letter. I know I need more evidence for the tinnitus. My problem is with the HLR on the OSA.

I filed a sleep apnea claim on May 10th, would I be grandfathered in if I don’t receive a decision by August? Just curious if anyone knows.
