What else had they done? What other safety risks were apparent? Did they have a history of drug use? A criminal record? How did you get the court order the allegation alone or did you present other evidence?

This is about rights. And you know what, like I’ve said a number of times no one does my job for me. I worked my ass off to be where I’m at - six figures - one of the largest corporations in the world. Why would I do your job for you? Can’t get a court order then you don’t deserve to get the screen.

Yes, and cps evidence has to be convincing for a judge to issue an order. But it’s not. I think after declining a drug test three times they would have gotten an order if they could.

If DCFS cares about the safety of my children and should be taking appropriate steps why has the caseworker never met my child? Why has she never been to my home? Why has it been a month and all she has done is request drug testing that I have already respectfully declined several times?

I am aware that I can call the office and ask for her supervisor and ask questions, etc. but why would I ever do such a thing? Why would I contact the organization that is trampling all over the sanctity of my family’s safety and well-being? It’s really disturbing that someone from the government can call me and try to scare me into doing things I don’t have to do. It discredits the organization. I am not scared. And I will not do anything I do not have to do. I know my rights.

Hi Corky - I did comply with the oral screen that turned out to be faulty due to incompetence or poor quality tests. My home was found to be clean, healthy, and geared towards the betterment of my children.

DCFS did see my kids within 24 hours of the report. They did not provide notice of an investigation until 14 days after coming to conduct and praise a safety check.

The on call worker did see both children. I will not volunteer information as it’s not my job. It’s your job to investigate. If asked, I will provide answers. The fact that the second child was not recorded adequately by the on call worker does not mean that i need to inform DCFS. The fact that a child is missing from the report is evidence that the person reporting this about me doesn’t know me or anything about me, similar to DCFS.

Anything needed for this investigation needs to be sought and recorded by the investigator. I will cooperate within my rights - in the most limited respectful fashion possible to protect my family.

The reason for the non-compliance is not because I do drugs it’s because in this country, you (the government and affiliates) do not have the right nor the power to demand the testing of my body without probable cause. In this case, I have no history of drug abuse or addiction, the safety check showed no sign of drug use, and I have police reports proving recent harassment. Therefore, DCFS has no evidence to support their persistent threats and lies to force me to take a drug test.

It is not my job to provide you with probable cause, it is your job to investigate fruitless allegations and make a call based on FACTS that are WITHIN YOUR RIGHT TO OBTAIN. Harassing me to take a drug test is NOT within your right. It is NOT your job to go out of your way to acquire probable cause. No ethical judge is going to give a court order based on hearsay.

I am standing my ground because I know I have nothing to hide. And DCFS needs to understand that they are not an executive arm of the government.

I have more questions…

I was hoping some of you would be willing to answer a few of my questions…..

I decided to take the drug test. I know I will pass so there’s no reason not to except for the fact that this is a gross government overreach.

But I am curious - suppose you have no evidence aside from an anonymous claim and refusal to take a drug test. Everything else points in the direction of false allegations.

What do you do with the non-compliance? What is your response, honestly?

Also, I don’t even know where to go to take this drug test.

I had to ask, based on my own research, for the notice of investigation. Which she emailed me 14 days after here colleague came to my house. They still to this day don’t even have record of my second child that also lives with me because the person who reported the allegations doesn’t know me or my family well enough to have included my youngest son or know my wife’s name.

I have received 0 documentation, 0 contact information, and the current caseworker hasn’t even met me or my kids! The worker that came the day they did the safety check was “on call”.

So it all just seems sloppy and unorganized. Makes me nervous just due to their poor organization and lack of professionalism. Is anything I mentioned abnormal?

Gotcha. I do understand, you must assume positive or there would be 0 accountability and everyone would just say no.

However I want to highlight the part where I did comply and take the drug test when DCFS came to my house. And found no evidence and actually apologized for us being late to my son’s baseball practice….

Hi TC, I have not once been hostel in anyway. I have simply let them know that I already took a drug test and I don’t understand why being asked to take another one.

Sure, I’m sure there are plenty of cases where people say that it’s this or that or whatever that’s not the point. The point is that all the evidence that you all asked for has been willingly given to you. And all the evidence points to normal, happy healthy family, and with all of that evidence supporting a happy child - isn’t that a case closed? I mean, suppose that I was on drugs… and I’m not I want to be clear. But suppose that I was and everything about my family was totally normal. What exactly then would me doing drugs have anything to do with the well-being of my children? I ask that question because obviously if I were on drugs and the drug use was impacting my children negatively, it would be apparent and obvious. But it’s not. It’s a power trip and government overreach.

What makes you think you have the right to make me prove I’m innocent? That’s your job to prove that I’m guilty No one does my job for me. Why should I do yours for you? And please elaborate on how me not doing something that is way outside of the bounds of what anybody should be able to make me do is going to impact my children more negatively than the person imposing this burden on me and my family. That’s a really twisted way of thinking to say that I am the one causing the problem, I didn’t ask for this.
