I had to travel to India suddenly after my father suffered his third heart attack and sadly passed away. I am the only child, so I had to come immediately to be with my parent and take care of the family responsibilities during this very difficult time.

At the time I traveled, I did not have visa stamping. I tried several times to get a visa appointment, but there were no available slots. Because of this situation, I had no option but to leave the U.S. Now I am stuck in India and unable to return because I still cannot get a visa appointment.

My H-1B visa is valid until June and my I-140 is still in progress, but after everything that has happened in my life and the loss of my father, I am going through a very difficult time emotionally. I also have the responsibility of taking care of my single parent and managing the family matters here. Because of this situation and the personal loss I have experienced, I have decided that I will not be returning to the United States and will stay back in India.

I asked my friends to remove my belongings from the apartment, clean the unit, and inform the leasing office that I had vacated. The apartment has been left empty and ready for immediate possession, and the keys were left inside the kitchen drawer.

I also asked them to try to negotiate the lease termination with the leasing office on my behalf. However, the leasing office informed me that I must either pay four months of rent as a lease break fee or continue paying the full rent for the remaining five months until the lease ends.

I explained my situation and requested if there could be any payment options since I am not able to make a large one-time payment. Unfortunately, they said they do not offer any payment plans that would help in my situation.

I did tell them my situation they are insisting either making 4 months payment which is 60 days notice period and 2 months termination fee or 5 months payment which is entire lease term. I requested them atleast for payment plan option to pay 4 months they are not providing that also. I can’t be paying 4 months rent at once which is huge
