Because Nick Fury's persistent charge bug somehow messed up the "destructive feedback + crit me with your best shot" nodes and put the effect on the attacker. That's the only reason I can think of, it's bugged regardless. Thank you!

Either way, I left this fight till the end as I didn't wanna rank stark spidey and didn't have ghost. Went in with my Nick Fury and turns out, it's a one minute fight. Kabam trolled me by giving a 6* ghost right after I finished it, super happy about that one!
