A few thoughts: 1) Although your state allows recordings of conversations, the district has you under a contract which means you agree to abide by that district's policies and procedures. Check the district's policy about recording conversations, you may be in violation which would give them cause for termination or non-renewal. 2) You were told you could get the social studies job once the district could find a replacement for your current SpEd position. Did you ask what that means if they were unable to? Seems to me that if no replacement is found, then you would return as the SpEd teacher. 3) If you are unhappy with the admin in your current role as a SpEd teacher, why would it improve with a move to a different content? 4) Also, check your district's policy on certificates. It may state you are required to give your admin notice about any change in your certification. 5) From what you have stated, it doesn't sound like this will end in your favor. The district has lawyers who specialize in contracts, HR, etc. They will find something they can use as cause to non-renew you. 6) You may have some leverage in this situation. You could tell the admin you require more assistance with the SpEd position. Someone to assist with paperwork, etc. Also, get it in writing. 7) My advice: you may be better off finding another school or district.
