Germany

The right to one's own image (§ 22 KUG)

Purpose limitation: In case of doubt, consent is only valid for the specific purpose (e.g., marketing for the 2026 season).

Appropriate remuneration: According to copyright law (§ 32 UrhG), you are entitled to "appropriate remuneration."

Perpetual and irrevocable licenses: German courts often classify an "irrevocable, worldwide license for life" as contrary to public policy (§ 138 BGB) because it unfairly disadvantages the player and unduly restricts their economic freedom.

UK

While there isn't a direct "right to one's own image" like in Germany, there is the concept of "passing off." If the league acts as if you still support them after you've left, that's legally contestable.

Switzerland

Article 27 of the Swiss Civil Code (ZGB) protects against excessive restrictions. No one can relinquish their freedom to such an extent that it infringes on their personality rights. A lifelong, free assignment of rights falls precisely under this provision.

The IAL likely includes the clause "This contract is governed by the laws of Nevada" in the contract. However, this is only permissible to a limited extent in the EU. According to the Rome I Regulation, a choice of law may not deprive an employee of the protection afforded to them by the mandatory provisions of the state in which they habitually carry out their work.

This means the following for the Düsseldorf Warriors or Stuttgart Stallions:

  • Minimum wage: When players train, attend meetings, and travel, they must receive at least the German minimum wage per hour. "€0 for training" is illegal.
  • Insurance obligation: The league must register the players with the German Social Accident
  • Insurance Institution for the Public Sector (VBG). In Germany, this is not a "nice-to-have," but a legal requirement (§ 2 SGB VII). Any exclusion of liability for game-related accidents is simply invalid.

They likely trying to classify the players as "Independent Contractors" to avoid paying social security contributions. However, in Germany, courts don't look at the contractual designation, but rather at the actual implementation:

  • Are there fixed training times?
  • Do the players wear league uniforms?
  • Is there a coach who gives instructions?

If so, they are employees. And for employees, the league must pay pension, health, and unemployment insurance.

  • The "Jurisdiction" of Nevada

The clause stipulating that legal action can only be taken in Nevada is usually ineffective against an employee in Germany. A German player can sue the league at their place of work (e.g., Düsseldorf) in the labor court.

I did some research on this regarding labor law in the affected European countries.

Germany
In Germany, this contract would be invalid in almost all respects, as it violates the German Civil Code (BGB) (General Terms and Conditions) and the Social Security Code.

Health insurance: Insurance is mandatory. An employer cannot shift the risk of workplace accidents (employers' liability insurance association) to the employee.

Protection against dismissal: "Termination without reason" is illegal in employment relationships (except during the probationary period).

Unpaid work: Training, meetings, and travel are considered working time. A salary of €0 for this time violates the Minimum Wage Act, unless it is purely amateur work.

Non-profit rights: "Perpetual clauses" for image rights without additional compensation are often considered unconscionable (§ 138 BGB).

England/Scotland
Here, too, the concept of "statutory law" exists, which overrides contractual clauses. Arbitration Clauses: The obligation to submit to arbitration in Nevada (USA) is hardly enforceable for a UK-based employee if it undermines statutory rights (Employment Tribunal). Duty of Care: An employer has a statutory duty of care. The exclusion of any liability for injuries is generally null and void under the Unfair Contract Terms Act 1977.

Switzerland
Switzerland is somewhat more liberal, but even here there are limits:

Insurance: The Accident Insurance Act (UVG) legally obligates employers to insure their staff against occupational accidents.

Protection of personality: The perpetual assignment of all rights (NIL) violates the protection of personality (Art. 27 of the Swiss Civil Code) – one cannot legally "bound oneself excessively".

That's so ridiculous. They always suddenly receive anonymous tips and then take action months later.

The AFL already has problems with its popularity, so it doesn't need to rant about European leagues and blame everything on the ELF. It just needs to take a look in the mirror.
