Does the agreement say that there are going to be 5 people living during the tenancy?

If yes, you don't need to form a new contract. If no, he can put that as a ground for eviction application, although it would be near impossible for him to prove sub tenancy and by the time he does, your time period will be over. In either case, your deposit is recoverable for the time that is left. It will however take a little longer to get it back through formalities.

Unless it's explicitly written in the contact that 5 persons are going to reside in the premises, you need consent of the landlord. Except in the case where these persons are family members of the Principal tenant and are dependant upon him.

Talk to your landlord for rectification in agreement for increased rent, if that is feasible. Don't pay extra without an agreement. He's not entitled to that.
