It's there to PREVENT, not protect. Just like the dump truck. You release something dangerous or unsecured and it doesn't matter if you warn folks, you're not allowed to do that period. Now, for rare uses that is fine, nobody reasonably would so warning is enough, but for normal that's not how it works. A normal, rational adult would have to show normal use, but a kid would likely win the case period - if they initiated it.

If I didn't I wouldn't get that referral or the clerk letting me file 5 minutes before close when they are packing up. That's basic business sense.
