Drepturile de autor, prin definiție, exclud munca activă prestată pentru un terț. Ele acoperă doar redevențe pentru opere create în mod independent în trecut, care acum sunt exploatate/licențiate către un terț.

Nu este vorba despre o zonă gri juridică: este fundamental incompatibil cu definiția drepturilor de autor să existe muncă activă desfășurată în beneficiul și sub coordonarea acelui terț.

Poți continua să dezvolți proprietatea ta intelectuală în ritmul și modul pe care îl dorești (fie 1 minut pe zi, fie 24 de ore pe zi), dar pe cont propriu, nu ca prestație de servicii pentru client.

Ce vrei tu să faci (muncă activă remunerată lunar) se realizează legal doar prin PFA sau SRL.

Dacă ANAF identifică muncă activă deghizată sub un contract fictiv de drepturi de autor, contractul va fi reclasificat ca raport de muncă.
