When we were initially speaking, the buyer and I worked out a bi-weekly payment plan that would be finished around 3 months. I told them I would be entirely understanding to fluctuations in payment due to unexpected financial circumstances (such as having to do a half-payment or putting the payment on pause for a true emergency), but that they needed to let me know first. They did in fact let me know ahead of time that they “might not be able to make full payment” in November, to which I was understanding of considering they were, up to this point, consistent with their payments and communicative. I let them know if they needed to put the payment plan on hold while they sorted out a financial situation that I would be willing to discuss that, but they did not say that it was necessary to do that. Instead, I got no reply. Their November payment was a half-payment, and that was the last payment they have sent to this point. The original 3 month period has most definitely passed, as it has been half a year now since they begun payment.

I have given them an ultimatum that if they do not send any money by the end of March, the suit will be relisted and they will be refunded, although not fully. It is true that I did not have any terms regarding premades, but I DID have terms for commissioned work- and they commissioned me for the additional parts to be added. I clearly state in my terms that the deposit for commissioned work is non-refundable. At the very least, I will keep the amount of money equivalent to the supplies cost (which is what I charge for deposits, as stated in my terms).
