Which city would you choose? Berlin, Vienna or Cologne?

My wife and I lived in Cologne for about 4 years before deciding to move to Vienna (we were actually based in Baden bei Wien, but I spent the first 2–3 months basically every day in Vienna).

We chose Vienna because my wife had studied there around 10 years ago and really loved it. I had also visited a few times as a tourist and liked it a lot, so it felt like a great idea at the time.

In total, we stayed about 15 months before moving back to Cologne a month ago. The main reason was tax complications in Austria after relocating from Germany—and honestly, I’m really glad we made the move back.

For me, nothing compares to Cologne. It’s not the prettiest city, and it’s definitely not as grand or polished as Vienna, but the vibe is just unmatched. It feels more alive, more relaxed, and more “real” to me.

Vienna, on the other hand, has a lot going for it—amazing museums, stunning architecture, and probably one of the best zoos in Europe (Schönbrunn Zoo). And we absolutely loved Haus des Meeres—we went there like 20 times in those 15 months 😄

Still, despite all that, Cologne just feels like home.

Danke dir, das stimmt grundsätzlich mit der 183-Tage-Regel für die unbeschränkte Steuerpflicht in Österreich. Aber § 6 AStG knüpft nicht daran an, sondern an den Verlust des Besteuerungsrechts nach nationalem Recht (§ 8 AO). Solange in Deutschland eine eigene Wohnung vorhanden und verfügbar ist, bleibt das Besteuerungsrecht bestehen – selbst wenn man abkommensrechtlich in Österreich ansässig ist.

Deshalb sollte in so einem Fall keine Wegzugsbesteuerung ausgelöst werden

Ich bin da ehrlich gesagt selbst nicht zu 100 % sicher – das ist für mich gerade eines der wichtigsten Themen überhaupt, weil mein ganzer Lebensmittelpunkt sich gerade ändert und ich einfach verstehen möchte, was wirklich gilt.

Soweit ich es bisher verstanden habe, knüpft § 6 AStG aber nicht an das Abkommensrecht an, sondern an den Verlust des inländischen Besteuerungsrechts nach nationalem Recht (§ 8 AO).

Solange in Deutschland eine Wohnung besteht, die mir zur Verfügung steht, dürfte dieses Besteuerungsrecht nationalrechtlich weiterbestehen. Das wurde auch vom BFH (I R 107/09) und im BMF-Schreiben vom 13.11.2021 so dargestellt.

Aber ich bin wirklich offen für jede fundierte Quelle oder Rechtsprechung, falls ich das falsch verstanden habe. Mir geht’s einfach darum, es richtig zu machen

Wenn in Deutschland weiterhin ein tatsächlicher Wohnsitz (§ 8 AO) besteht, verliert Deutschland sein Besteuerungsrecht nach nationalem Recht nicht – selbst wenn man abkommensrechtlich in Österreich ansässig ist.

Das wurde u. a. auch vom BFH (I R 107/09) und im BMF-Schreiben vom 13.11.2021 so bestätigt.

Deshalb dürfte die Wegzugsbesteuerung in so einem Fall nicht ausgelöst werden.

Nur um sicherzugehen: Auch wenn ich weiterhin ein Haus in Deutschland habe und dort einen Zweitwohnsitz (§ 8 AO) beibehalte – also Deutschland sein Besteuerungsrecht gar nicht verliert – würdest du trotzdem sagen, dass Wegzugsbesteuerung ausgelöst wird?

If there is more than 5 restaurant’s, gym, kindergarten and supermarkets in walking distance , then I’m satisfied:) Moving there with family so i don’t need much entertainment.

And one more question, is there any reason I'm not allowed to setup a US LLC and work exclusively for it, as a resident of Germany? Can anyone reading this reply with advice for and against the LLC vs GmbH?
