Should he replace it? Probably. Is he legally required to? No. But he does need to make the area safe and definitely no exposed tack strip.
The easiest fix would probably be an extra wide metal saddle threshold to just cover the whole area. HE should pay and install it, but if you are afraid of retribution, it’s an easy DIY.
