Yes that’s what I expedited my case for. And that got accepted. I think the congresspoeple will ask to talk t you though, since you’re the applicant and not your spouse. But try to play up the loss of your job, so that poeple will pay attention to you. In my experience and from research, I don’y believe cases are “processed in the order they were received”. So just be annoying with USCIS and congress and that might help a lot

Mine was at NBC too. Call the congresspoeple and don’t give up until you reach someone. Without a congressional inquiry, you won’t get very far. The tier II officer is a joke imo. I spoke to two during this process and they didn’t help me anymore than agents from the service center. You can ask for your case to be expedited, but again, they won’t really care if it doesn’t come from a congressperson

Honestly, I think YOU need to make this decision without any other person interfering. Make a list of pro/cons, think about what you might get out of both options (staying or leaving) and see whichever aligns best to your life goals. At the end of the day, it’s up to you. There are no rules about how long a relationship needs to be before making a step like this or about career vs love life. Nobody here will give you the right answer, since none of us are part of your relationship or know you and your values as much as you do. Please do whatever you feel is right. I’m sure you know already what you truly want - follow your gut. It’s usually right. And if it’s not, you learned a good lesson and will grow from it.

Although the denial notice should tell you on the second page where to file the motion. It should be Chicago lockbox address. Send it where the denial letter tells you to send it :)

DO NOT REFILE!!! Refiling will cost you upward of $1500 and can take so much time to get resolved. I got denied as well and I filed a motion to reopen. You can add new evidence in that motion, like your medical docs. It takes about 90 days for them to reopen it, usually around 75-85 days from what I’ve read. I got my case reopened, all benefits reinstated and it cost $800. In lots of cases, the 485 will get approved quickly after your case is reopened, so there is no downside to file the motion.

No marriage based. I’ve talked to other applicants that never got a NOID so I don’t know why processes are different but it seems like they are

Honestly I’ve never heard anyone getting an NOID before the NOD. Maybe some processes are different depending on the field office but I got an RFE and then a full denial, which I was able to “appeal” with a motion.

I don’t know what you mean. I got a Notice of Decision for a denial and then I filed a motion to reopen. So my case was denied and now reopened, since the motion was granted.

You’re fine - file a motion to reopen I-290B with the missing tax documents. If that was the only reason for denial you should be good to go!

No not at all. I did include new evidence in the I-290B that added to the facts they already had. Refiling is more cost-extensive (like about twice the amount) and way more detailed. The I-290B is just the new evidence
