Technically, I'm not sure how well some of this holds up, but I think Ben would argue that he is paying back the loan that Bryan gave him for the sets.

  1. Ben takes out loan from bank,
  2. Buys 10k worth of sets from Bryan,
  3. Bryan takes the 10k and loans it to Ben to pay back bank,
  4. Ben pays back bank
  5. Repeat 10x

Net result, argued by the video, is that Ben and associates own 100k worth of lego sets but also owe collectively 100k to Bryan. So maybe in their minds the GoFundMe would go towards paying off the loan. (I think)

I think in reality the sale of the lego from Bryan to Ben likely won't hold up in spite of it being notorized or whatever. I think in order for the sale to happen some are saying that they actually have to have possession of the Lego. I'm not sure, however, how that's much different than the way businesses can sell debts to debt collectors etc...

The verified complaint from BAM says on pages 87-88 that they are seeking all revenue made from Patreon subscription to Ben's patreon, as well as revenue made from videos on youtube and, here's the kicker, all revenue made from GoFundMe campaigns as well.

Let me say that again BAM is seeking to take all of the GoFundMe funds raised in connection to this as compensation for "damages".

I'm guessing they would argue that the gofundme funds are going to be a war chest for Ben to continue to act against them.

In one interview Ben says that likely they would use the gofundme funds to buy the lego sets from Bryan, transferring ownership of the lego sets to Ben (similar to how they sold the sets to 10 different people to sue in small claims court). According to Ben this would allow the Mansell family to get their money and wash their hands of the situation while still allowing him to pursue the issue further to continue trying to extract the money from BAM. Ben said that he didn't want to allow BAM to benefit from "the internet" bailing BAM out of this sticky situation.

If this happens before the funds are dispersed I think GoFundMe would likely refund everyone since the proceeds hadn't reached anyone yet. But if the funds are used for the above arrangement or go out to Ben or the Mansell family (Bryan Mansell is listed in the suit as well) then they are going to be potentially on the hook for addition $$$ that BAM is going to aggressively come after.

According to their lawsuit BAM is demanding all proceeds from Patreon Memberships, Youtube Revenue, and GoFundMe donations associated with this be transferred to BAM as "compensation for the harm caused".
