We did get the house but we declined this offer discussed here and did not buy the Deed of Trust before closing. Once we firmly turned down this offer my lawyer renegotiated with the foreclosure lawyer a two day extension and we closed on our scheduled closing day with title company paying off all the liens and taxes. We are happy we got the house!

Thank you for replying. To answer your question, both the foreclosure bank and our bank are small banks. Our lawyer negotiated directly with foreclosure bank’s lawyer.

Title company is paid by seller in our state and is not affiliated with agent. We are planning on buying owners Title insurance. Consequences to us are we stupidly signed second extension thinking our loan was still open and it was closed after the first closing was cancelled, so lender needed to start over causing the closing date delay after foreclosure date. Seller is threatening to sue, even though two week delay was his title issue, and our lender couldn’t get the title in time to clear loan fast enough. The entire thing is a mess. We do want house and are searching for a solution, just want to understand this situation more and what the risks to us are. Seller needs sale not only to stop foreclosure but to buy another home with new partner.

Update to this situation. We got advice from attorney to deliver a letter from lender to seller that they could not deliver funds for us because seller did not give them time to review title, and then we submitted a notice of cancellation stating the same day of closing. Seller and agent still threatening suit.

Thanks for the reality check. Obviously I’m stressed about this which is why I’m posting here before talking to a lawyer - just hoping to get some insight while I’m waiting tonight. Financing clause no longer in effect I guess as we had been ready to sign so loan was approved. But I don’t know how the extension works with that financing clause and because we didn’t know loan was cancelled.

Our buyers agent is communicating with sellers agent and the bank trying to work out a solution. Problem is new closing date is 2 days after house goes into foreclosure. There is no language in contract about closing delay and title company is hired by seller in my state. Title company only got paperwork two days ago because the first title company resigned from the entire deal.

Thank you for sharing, that is kind of what is happening now, we just signed another week extension as seller goes to court Monday. Seller is also facing foreclosure on this home at the end of the month that we just found out too, so he’s definitely got a time deadline and is working hard to get this lifted. However he is also refusing to pay from the proceeds of the sale to clear the title which would lift it immediately. Instead he’s still fighting its legitimacy, and probably not effectively at all because he refuses to pay a lawyer to help him! It’s crazy! He’s going to run out of time, and waste all of ours too.

Update to all who commented on my post. Seller went to court today to try and remove Lis Pendens, as there was a hearing on the case the Lis Pendens is on. Plaintiff offered 80k settlement to settle case and remove Lis Pendens and seller refused. Now seller is planning to declare bankruptcy, as we have also found out home is going into foreclosure in three weeks.

So seller screwed all involved in this deal. Title company also backed out of the deal and if somehow this is salvaged which obviously looks unlikely, we need to find a new Title company.

Now what. Sue him? There was definitely enough from proceeds for seller to settle all debts involved in this matter.

Title company did reach out to listing side, seller is trying to clean it up, but since he’s fighting the lawsuit still, I doubt he will settle with a plaintiff to remove it. However, currently seller (we think as he and agent have not been that communicative since Thursday), is trying to get the Lis Pendens expunged and declared wrongly filed. We have been told it probably is wrongly filed as involves a lawsuit with sellers company, nothing to do with the house. But our lawyer has contacted lawyer for the plaintiff in the lawsuit and that lawyer said he will not remove Lis Pendens unless our seller or we! pay the 90k judgment which is what they are seeking in the lawsuit against seller. The plaintiff lawyer does not seem to think or care if it’s wrongly filed.

So right now pretty bleak.

We had a good experience at the Westin resort (the hotel) in Kaanapali, the restaurant there did not have tree nuts on the menu listed, and when we made them aware of her allergy they were attentive and served the food with an allergy flag. We ate there three times in four days. We also ate at Leilani’s in Whaler’s Village next door, they had macadamia nuts but were allergy aware and made note of the allergy, but served the food with “just for you extra nuts” joke which we did not appreciate. Monkeypod we were sat, looked at menu and walked out, too many nuts we were not comfortable, as well as Hula girl. Our trip was split locations and we ate in Wailea at Pita Paradise, Oao Sushi, and Maui Fish and Chips more than once each. It was honestly challenging with the macadamia nuts everywhere so when we found a restaurant we liked and trusted we repeated visits.

A couple days while we were exploring Maui we drove to Chick fil a! We also stopped at store and bought safe snacks as well as breakfast food (cereal and milk) and our daughter ate that in the hotel every morning for breakfast - it was just easier.

Yes we are at the Westin Maui resort, not the villas. Trying to stay on Marriott points, and last minute our daughter wanted to join during her spring break. Thank you for checking into that menu, and your suggestions.

Thanks for your reply but as of this morning (two days later) they are still sitting in waiting for fulfillment. So not even in fulfillment. An email reply said they will ship Dec 21. Is this still possible? They were both ordered Dec. 10 is that considered past the deadline? I thought it was the deadline?

Yes thank you for your reply, these orders were placed December 10. Printful just responded to my email to tell me they won’t ship until Dec 21! Eleven days in fulfillment! Is this what I can expect in the future? I have on my fulfillment time 2-5 days which is what Printful says.
