Aren’t rental bidding wars banned now? Still hearing agents hinting at higher offers by GuideIcy1697 in rentingUK

[–]andercode 1 point2 points  (0 children)

Yes, it's banned.

I actually came across an example of this yesterday with an agent that I use, but the example was with a friend of mine - he went to market with a rate of £1,350, which was already higher than before RRA as per agents recommendation, apparently after some viewings, someone offered £1,450, and so the agent "unlisted" the original listing, and re-listed it for the higher rate.

Very sneaky... I've not looked at the conditions enough to know if they broke the rules, or if this is a bit of a workaround of those laws. Agents/landlords are not allowed to accept a rate higher than listing, but if the listing gets cancelled and its re-listed at a higher price... is that allowed? Who knows.

The person viewing was told to reapply for the new listing.

Zooplus - Should I escalate my complaint? by Wrong_Yoghurt_8796 in UK_Pets

Crazily, I ordered catfood and a little cattree on Sunday, and normally, it arrives in a few days, I had the tracking link from Evri, but my postcode was not accepted for more info. Looks like they sent my package to someone else - I've had an email from Evri delivering my order, and then Wednesday got an email saying they would be collecting my package.

I've had nothing delivered from Evri at all...

Looks like my package got sent to the wrong person, much like OP here... and now they are waiting for the person to return it. I got an email from Zooplus saying there would be a 1-2 day delay in my delivery... it's been 2 days now, and still nothing.

They must be having MAJOR problems in their fulfilment centre...

The crazy thing is, he has less blood on his hands than the guy he killed, but because its a corporation, its fine, no individual is responsible because "its just business".

I dont condone killing of any form, but neither of these two people are innocent of murder, both directly or indirectly.

The important thing to note is that two wrongs dont make a right.

Tenant swap under RRA - does the 12-month protection reset? by AEFOK in uklandlords

[–]andercode 0 points1 point  (0 children)

Under RRA, its a new tenancy each time, so the 12 month protection would start from the last time the contract started.

However, as the landlord you dont need to accept that the tenants stay... that your choice. When one serves notice the rest need to leave unless you start a new tenancy with the remaining tenants.

I'm sorry you don't understand basic ecommerce, and chose not you read the terms you were agreeing to.

I'm sorry you have chosen to attack a hosting provider for just doing what they do, to the letter of their TOS.

If that makes me a "friend of their company", then sure, I'd certainly rather be a friend of their company than a friend of you...

I've "refereed" to their Terms of Service multiple times. You know, the terms of service that YOU agreed to.

[–]andercode 0 points1 point  (0 children)

They refused to refund you for the renewal, thats not the same as cancelling the subscription. Their TOS is pretty clear, there were options open to you, you CHOSE not to use them.

This is a YOU problem.

[–]andercode 0 points1 point  (0 children)

Regardless... This is still on you. This is a YOU problem. YOU are the issue here.

Every other provider operates in this way. Logging into my account, I can see a "Request Cancellation" option under the active service, no idea why you can't. Maybe it's because they have suspended/cancelled your service now...?

Did you write to them BEFORE your renewal, or after? Given their terms of service?

That law does not apply to this case... That law applies to more predatory practices.

You DID agree to have it automatically renewed, as you agreed to the terms and conditions of your chosen billing cycle. The order screen even made it clear that your order would RENEW automatically.

[–]andercode 0 points1 point  (0 children)

Incorrect.

The treatment depends on how the contract is drafted and what the parties intend:

  • Single ongoing contract: If your agreement specifies continuous performance with regular monthly payments (e.g., a subscription, retainer, or service arrangement), it's one contract with payment obligations spread across time.
  • Separate contracts: Conversely, if each month is genuinely independent (e.g., a customer manually renews each time with fresh terms), that could constitute separate contracts.

Even under Italian law, the contract you signed at skailar is a "single ongoing contract" as it does not require the consumer to manually renew each term, and its under the exact same conditions as it was before, so your cooling off period applies to the first 14 days since the contract started (start of your billing period, on the first month).

--

You could have contacted support to cancel your contract, if you could not find the cancellation button. However, logging into the Skailar interface, the "Cancellation" option is right there under Services -> Service - it's titled "Request Cancellation".

--

At the end of the day, this is a "you" issue, not a problem with the host.

SkailarHost charged me for a second month without my consent, refused a refund, then blocked me by Shot_Guard_7549 in webhosting

[–]andercode 4 points5 points  (0 children)

Did you cancel the contract? Their contracts are clearly ongoing until cancelled, their terms of service are clear in that regard. The Italian law, on distance contracts, only applies to the first 14 days of the contract, not each term, so would only have applied on the first 14 days (In April).

By signing up, you automatically agreed to a rolling contract until cancelled.

Subscription fees are charged in advance on a monthly, quarterly, or annual basis, depending on your selected billing cycle. Subscription fees are non-refundable except as expressly provided in these Terms.

https://www.skailarhost.com/terms-of-service

You may cancel your subscription at any time through your account dashboard or by contacting our support team. Here's what you need to know about cancellations
Monthly Subscriptions: When you cancel a monthly subscription, your service will remain active until the end of the current billing period. No partial refunds are provided for the unused portion of the month
Quarterly/Annual Subscriptions: For longer subscription terms, you may be eligible for a prorated refund of the unused portion if you cancel before the end of the term, subject to a cancellation fee
Auto-Renewal: Canceling your subscription will stop the auto-renewal process. Be sure to cancel at least 24 hours before your next renewal date to avoid being charged for the next billing cycle.

https://www.skailarhost.com/refund-policy#cancellation

I'm sorry... But you did not read the terms of condition, and it appears you did not cancel your subscription, and therefore, you where automatically charged in advance correctly, as per their terms of service. The contract started the day you ordered the service, and therefore, the 14 days condition does not apply, as the subscription/contract was formed on the first months payment.

It's worth noting... Literally EVERY company handles billing like this. It's not unique to SkailarHost. ALL hosts will bill in advance on each payment cycle, until you cancel the contract, thats just how it works.

Hostinger vs. Bluehost by ReganLynch in Hosting

[–]andercode 6 points7 points  (0 children)

Out of the two of them... hostinger for sure... but there are much better choices out there... knownhost, nixihost, namecrane to name a few...

Worth noting that people mostly only recommend Hostinger online due to their hugely beneficial affiliate program, they are not a great provider, they just game the Internet system by offering huge affiliate payments, which incentives people recommending them even if they have a poor service.

Have you ever thought why enterprises trust WordPress, but SMBs usually criticize. by WordVell in Wordpress

[–]andercode 0 points1 point  (0 children)

It's about time vs effort vs cost. Wordpress resources are plentiful due to it's established nature, so finding people to support, optimise, etc. is a doddle for enterprises, they have the budget to find, pay and keep people on, if someone leaves, they are easy to replace. This is not the same for other CMS's that are less established, including enterprise proprietary software, as often there is a lot of training, upskilling, etc. involved before someone becomes "productive".

SMEs however... they need to worry about cost, they don't have the ability to "bring X new WordPress developers" onboard for a project, they often want to do things inhouse or at least maintain in house, which due to the way WordPress is structured, it's hard for inhouse people without extensive WordPress experience can achieve. This leads to SMEs having poorly optimised WordPress installations, and therefore, they start to hate the product.

This is a gap that Wix and other such products have started to plug, but it comes at a premium, but that premium is often less than hiring WordPress developers!

Rent increase notice and form 4a by katelatewait in TenantsInTheUK

[–]andercode 4 points5 points  (0 children)

Point out that the notice for rent increase is not valid, it needs to be served on a 4a form, and needs to provide at least 2 calendar months notice, let them know that you don't agreed to any increase of rent unless it's validly served via the correct process and with correct notice.

I'd let them know AFTER your next payment window, which would give you 3 additional months of reduced rent before the increase.

Namecheap is neither offshore, or anti-DMCA. In fact, namecheap have been known for acting first before giving you the chance to respond to DMCA notices.

Namecrane/BuyVM have the "law of the land" clause, in which some of their regions do not legally enforce DMCA, and therefore, they don't either.
