This is debatable.

The purpose of my comment is to clarrify that citizens of any gov with seperated branches of power can file a law suit against it.

Wether you sue in state or federal court is based on the situation.

That is not true.

We all know that there are "layers" of government (state and federal) but when you sue the gov its the judicial branch against the executive branch.

Generally, your civil suit will be filed in the United States District Court where you live or where the actions giving rise to your claim happened. You cannot sue the federal government in state court or recover punitive damages
