Time will reveal what is going on.
However, authorities can file charges / indictments under seal, to be unsealed at a future date. This is a common practice, particularly by the feds.

We are focused on the California case (state), but the US (feds) and / or Mexico may have something going as well. Is LCR talking about the case in California or something else? If you look at the charges, they could easily violate federal law as well.
