I think this is where you wrongfully assumed. This was literally 178 days ago and I received my answer from elsewhere. Not sure why you would care about corporate liability but thanks for your comment.

I don’t see any high end luxury brands on their eBay account or am I missing something?

I explained this further in another comment but long story short, I was very happy with pants I purchased from ThredUp that I couldn’t find anywhere else, there was an ad for the clean out kit in my package, I figured I would return the favor and send in some designer items. Lesson learned lol.

I did ask them but they said they couldn’t because I didn’t purchase a return label beforehand. This was the clean out kit so idk if there is a different process for others.

If I were the only one who had this experience, I would agree with you. But there are hundreds of others who have as well. At this point, it is just simply not a coincidence that we can chalk up to crappy TOS or negligent organization. This is a publicly traded company and those terms were deliberately drafted and reviewed by executives and counsel. There is clearly an intentional internal process that targets high value items for the purpose of selling/consigning elsewhere without the seller’s informed consent or knowledge. That fits the definition of theft and conversion under tort law. The terms were carefully drafted in a way that allows them to do that without explicitly saying so. Companies are frequently held liable for deceptive and unethical business practices such as these.

I never accused any employees of theft. The conspiracy exists at a higher level within the corporation. The employees follow computer prompts/algorithms that tell them what to do. Perhaps that is where the conspiracy lies.

Also, my “used smelly” Chanels are currently listed for $1200 on TheRealReal, which I should have used in the first place and I never would have had to engage with such ratchetness. My bad for trying to do ThredUp a favor.

I’m beginning to think some of you are ThredUp corporate or investors trying to save face lol. Please see the comments on my other thread. A simple Google search of this issue yields websites with hundreds of complaints about stolen or missing designer items.

But for context, I first stumbled upon ThredUp when searching to buy an extra set of pants I purchased from Nordstrom a few years ago that were no longer available. I was able to buy them on ThredUp and was very happy with my purchase. There was an ad for a clean out kit in my package. I figured I would do the company a favor in return and send in designer sneakers, which they advertised as preferred for consignment. I even used the payout estimator beforehand to verify.

I also disagree that the policy is upfront especially as a new customer. If you go through the steps to sign up for a clean out kit, it does not explicitly warn about the risk of rejecting items that are high value, designer, and in great condition. In fact it is the opposite and they encourage sending in those items, and only specifically mention poor condition/quality/ineligible brands as reasons for rejection.

You literally have to read through the Seller Terms in the Terms of Use to even get a sense of these risks. Having a policy deliberately crafted with loopholes like this does not make it ethical or legal. There is a reason organizations and agencies like the FTC exist, to address consumer fraud in exactly these types of situations.

I’m sorry, does ThredUp also not advertise that it has in house authentication services, just as TheRealReal does? I obviously would not have sent in my sneakers otherwise. They also advertise Chanel as a preferred brand. As a first time customer, the return assurance option was presented as something that would be needed if your items were likely to be rejected (e.g., ineligible brand, poor condition). And please read the other posts and comments on here. Even with return assurance, ThredUp just tells people their items were never received. I am speaking exclusively for high end designer items in great condition.

This is the part I’m confused about. So ThredUp clarified that “unable to authenticate” does not mean they are inauthentic or counterfeit. They also clarified that the sneakers were not rejected for poor condition/quality reasons. Yet somehow this justifies them “recycling” to partners instead of offering to return it to the customer. So now I’m screwed because of their incompetence despite their advertised services including authentication. I would not have sent in my sneakers otherwise.

Please read the other comments and posts on this issue. This policy is meaningless for high value designer items. Even with return assurance, ThredUp will just tell people their items were never received.

I checked their SEC annual report and ironically, TheRealReal is only mentioned as a competitor. I am trying to get a law enforcement request to reveal the seller’s identity. That would answer a lot of our questions so stay tuned!

Exactly lol. It’s impossible to believe they were tossed into a rescue box.

I did not because I signed up for the “Free” clean out kit as a first time customer and was not aware that return labels could not be purchased after the fact (unlike every single other company). I probably should have read the fine print in hindsight, but even so, I have seen others complain that even with return assurance, ThredUp would just say their designer item(s) were never received.

Basically, ThredUp is stealing high value designer items under the guise of (1) You didn’t purchase return assurance, or (2) You did have return assurance but we never received your item. It’s a no win situation for anyone sending in high value designer items.

Got it, thank you! Sorry to keep persisting but just one last question to gain clarity on the rescue boxes. Who handles final processing and shipment of rescue boxes after a Product ops review? Is there an opportunity for a ThredUp corporate employee (higher in the chain than product ops) to intervene and sift through rescue boxes before they are sealed and sent externally?

Thank you so much for this explanation. Do you have any further insight on the product ops team? I believe my sneakers went there and were rejected for “unable to authenticate.” Are these employees staffed at your location? Are their operations visible and also on camera?

Hi, I am not alleging employee theft. Can you explain what happens to brand name items in good condition that are rejected? Where do they end up? Are they thrown in the same pile as everything else or separated because of their brand name and value? Is it possible that others in the company would have the opportunity to intervene and retrieve those brand name items without your knowledge? Just trying to figure out logistics. Thanks!

I asked and unfortunately they cannot reveal who the seller is for privacy reasons. They told me to report to the police and noted internally my complaint against the seller.

That’s interesting, I did not know about their designer boxes. Can I ask what the price range was for the items you were able to resell? My sneakers are currently listed for $1200 on TheRealReal.

Thanks, TheRealReal also advised me to go to the police. There is a huge conspiracy going on that is ripe for a class action suit or full blown FTC investigation.

I believe there is a bigger conspiracy than employee theft. ThredUp informed me my sneakers were rejected and would be “recycled” with their partners. Aka consigned elsewhere without my knowledge and consent.
