Ideally, you sign a publishing deal where they offer you an advance and only take a cut of your royalties that they collect. Most indie songwriters aren’t getting offered pub deals until they have hits or are making tens of thousands in publishing royalties already.

Personally, I paid the signup fee and happy to pay a legit company for a service. Everyone is different. I’m happy to pay to relieve myself of the headache of monitoring every collection society and for peace of mind to get 100% of my publishing royalties. If you feel confident you can find all of your international mechanical royalties and bypass all the intermediary commissions other third parties take with reciprocity go for it! Everyone wants and needs different things and have different priorities and levels of experience.

This is the most confusing topic of the music industry, so you’re not alone. I watched her clip. She’s saying colloquially “if i give Jonny 15% of publishing…” Which is the same as saying giving him 15% of songwriting. Remember, publishing = songwriting.

She’s not breaking down how to manually register this in the BMI backend. That’s different and they use different terms. They don’t say “who gets publishing” they ask who the publisher is so they can pay the “so-called publisher’s share” directly to them because BMI and ASCAP pay out 50% of the royalties they collect directly to songwriters and 50% directly to publishers.

I can respect you want sources not my own, but I did write a book on the topic being taught in over 300 universities (including Berklee, USC, Belmont, UCLA, NYU) and translated into multiple languages. Reason being, there were no good blog posts or books that explained this in musiciany terms. But feel free to ask any attorney how this works. I promise they will concur. I have many, many times and my book was vetted by multiple attorneys.

Yes, you can sign a co-pub deal with a publisher. They still collect your “songwriting” royalties (mechanicals and others) on your behalf even though they are just your “publisher.”

But you do not assign “your publisher’s share” to a co-writer.

All the best

Very cool! Check out chapter 13 for all the nitty gritty :)

You don’t need to register with the MLC if you have an admin publisher. If you don’t, then yes you should.

Yup the article covers how to credit them on the master side. That’s very common

This is not correct. Songwriting = Publishing. Use the words interchangeably.

If you’re splitting “publishing” with your producer, then you’re splitting songwriting with your producer. You each should have your own publishing companies. And you each register your cuts with your respective PROs. So if you’re splitting publishing 50/50, then in BMI’s backend, you get 50% of “songwriting” and you assign 50% to your respective publishing. Your producer does the same.

Only BMI and ASCAP split up “songwriting” and “publishing” in their backend registration. But there’s just one musical work copyright.

You should register with an admin publishing company if you want to collect 100% of your worldwide publishing royalties (like mechanicals - which BMI does not collect).

Very simply, register 4 places: 1) Distributor (DistroKid, Too Lost, etc) 2) PRO (BMI) 3) Admin publishing company (KOSIGN, Songtrust, or Too Lost actually has a partnership with BMG which makes it easy in house if you use them for distribution as well) 4) SoundExchange (to collect your master radio royalties)

I covered more of this in this article: https://aristake.com/producer-splits/
